| The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents:
• Survey – Location Plan J1009018-01 Rev A dated May 2025;
• Planning - Block Plan J1009018-11 Red A dated June 2025;
• Planning - Plans [Proposed Floor Plans] J1009018-12 May 2025;
• Planning Statement dated 31st May 2025;
• Planning - Block Plan showing Location of Toilet received 11 August 2025;
• Level 3 Flood Risk Assessment by Floodplan Limited dated 1 August 2025;
• Map 1. Potential Safe Exit routes from Oak Farm in the event of Surface Water Flooding, received 1 September 2025.
Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The development shall not commence until a Habitat Management and Monitoring Plan (the HMMP), has been prepared in accordance with the approved Biodiversity Gain Plan and the approved landscape scheme, submitted to and approved in writing by the Local Planning Authority. It shall be based on the recommendations made in the: Small sites metric received 12th July 2025, baseline, Baseline and proposed BNG plans received 12th July 2025 and BNG Tree Planting Plan received 22nd August 2025, and shall include:
(a) a non-technical summary;
(b) the roles and responsibilities of the people or organisation(s) delivering the HMMP;
(c) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan;
(d) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development; and
(e) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority. Notice in writing shall be given to the Council when the habitat creation and enhancement works as set out in the HMMP have been completed.
The created and enhanced habitat specified in the approved HMMP shall thereafter be managed and maintained in accordance with the approved HMMP.
Monitoring reports shall be submitted to the local planning authority in writing in accordance with the methodology and frequency specified in the approved HMMP.
The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the HMMP are not being met, how contingencies and/or remedial action are identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme.
Reason: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The development hereby approved shall not be brought into use until the proposed vehicle parking, as shown on the Planning - Block Plan J1009018-11 Red A drawing, and marked with a ‘P’, has been provided. The parking facilities shall thereafter be retained and kept available for vehicle parking associated with the proposed development (agricultural, F(1) Learning and non-residential institution and F(2) Local Community Uses and associated land) together with any cars, vans or minibuses associated with the residential parking at Oak Farm which may be agreed through condition 9, only, at all times.
Reason: To ensure that sufficient parking and circulation space is provided on site in the interest of highway safety, in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The development hereby approved shall not be brought into use until the site access visibility splays, measuring 2.4m x 53.1m and 2.4m x 47.4m shown on Drawing No. 27379-01 B (Existing Site Access Visibility Splays), have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above the adjoining carriageway.
Reason: To ensure safe access to the site in the interests of highway safety and public convenience, having regard to policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The development hereby approved shall not be brought into use until road traffic signs have been fully installed in accordance with the following document: Response to Worcestershire County Council Transport Planning and Development Management Consultation Response (dated 30th June 2025). The signs shall be retained and maintained throughout the lifespan of the development thereafter.
Reason: To ensure safe access to the site in the interests of highway safety and public convenience, having regard to policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The Development hereby approved shall not be brought into use until a Vehicle Parking and Access Strategy has been submitted to and approved in writing by the Local Planning Authority, in consultation with WCC Highways. This shall include, but not be limited to, the following details:
• How vehicle parking provided for the proposed development will be allocated, monitored and managed;
• How on-site deliveries/servicing will be safely accommodated, so this does not interrupt vehicle circulation or block parking bays;
• Should vehicle parking demand exceed supply at a specific time of the day, how this will be mitigated / managed, to ensure this does not generate impacts on network safety;
• How the vehicular access from the highway, the apron and the site access is to be used by vehicles. Vehicles entering the site via the apron must keep to their left at all times. Vehicles exiting the site must give-way at the site access before proceeding onto the apron and must also keep to their left. At no time are vehicles permitted to block the apron; and
• A named person responsible for the Strategy that WCC can contact should issues be identified.
The vehicle parking facilities and access shall thereafter operate in accordance with that approved Strategy.
The approved Strategy must be shared with all staff and visitors to the site. This Strategy must be implemented and reviewed at six-month intervals, so long as the site operates under F(1) and F(2) use.
Reason: To ensure safe and suitable access for all users and to ensure the free flow of traffic using the adjoining highway, having regard to policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation.
No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed by the Local Planning Authority, until requirements 1 to 4 below have been complied with:
1. Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency's 'Land Contamination: Risk Management' guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place.
2. Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation.
3. The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority.
4. Following completion of measures identified in the approved remediation scheme a verification report that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site.
Reason: To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property, and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors, in accordance with policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| No part of the development hereby permitted shall be occupied for educational or community uses beyond three months from the date of this decision unless it has been demonstrated and approved in writing by the Local Planning Authority that the site can accommodate the necessary vehicle parking in line with the adopted WCC Streetscape Design Guide for the proposed residential uses associated with the host dwelling (Oak Farm), or an alternative scheme to accommodate the residential parking is demonstrated to be acceptable. The development shall thereafter be carried out in accordance with the approved details.
Reason: To ensure that the proposed development is carried out as approved and that sufficient parking is provided for the proposed educational use and adjoining residential use, in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the occupation of the development hereby approved for education or community uses, access ramps shall be installed (without physical attachment to the listed buildings), in accordance with the Site and Building Accessibility Statement that was submitted to the Local Authority on 24th July 2025. The ramps shall remain in place for the duration of any educational or community uses occurring on the site.
Reason: To ensure that the development allows for access for all, having regard to paragraph 135 of the National Planning Policy Framework. |
| Prior to the first occupation of the development hereby approved, secure parking for at least two cycles to comply with the Council’s standards (set out within the WCC Streetscape Design Guide), shall be provided within the site and these facilities shall thereafter be retained for the parking of cycles only.
Reason: To ensure provision of an adequate and satisfactory standard of bicycle parking on the site, in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Unless within three months of the date of this decision, a scheme demonstrating the surface water drainage systems to serve the hardstanding associated with the development is submitted in writing to the Local Planning Authority for approval, and unless the approved scheme is implemented within six months of the date of the Local Planning Authority's written approval, the use of the site for educational purposes shall cease until such time as that scheme is approved and implemented.
Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved Habitat Management and Monitoring Plan (HMMP).
Reason: To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Should no scheme in accordance with condition 9 above be approved by the Local Planning Authority and subsequently implemented in accordance with approved within five months of this permission, the educational and community use of the site hereby approved shall cease forthwith until such time as that scheme approved in writing by the Local Planning Authority is implemented.
Reason: To ensure that the proposed development is carried out as approved in order to ensure that sufficient parking is provided across the site, in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| In dealing with this application, the Council has worked with the applicant in the following ways: seeking further information following receipt of the application and by considering the imposition of conditions and or the completion of a s.106 legal agreement.
In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. |
| There shall be no more than 12 visitors (defined as individuals using the educational and agricultural facility who are not members of staff for the facility or staff of the visiting groups), present on site at any one time.
Reason: To ensure that the site's parking infrastructure can adequately accommodate the level of visitors, having regard to highway safety in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework |

| The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless:
(a) a Biodiversity Gain Plan has been submitted to the planning authority, and
(b) the planning authority has approved the plan.
Subject to Paragraph 14(2) of Schedule 7A TCPA 1990 The biodiversity gain plan must include:
(a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat;
(b) the pre-development biodiversity value of the onsite habitat;
(c) the post-development biodiversity value of the onsite habitat;
