Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Original plans: 125683 - 001 D; 125683 - 002 E; 125683 - 004; 125683 - 006; Amended plans (received on 28 July 2025): 125683 - 004 E Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; and - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
The applicants attention is drawn to the fact that the land located to the north of the barn previously proposed for use as a car park (under application W/22/02173/FUL) falls outside of both that consent, as well as the consent hereby granted and relies upon the permitted temporary use of land set out under the General Permitted Development Order Part One Class 4. This allows its use for parking for up to 28 days per calendar year. It is recommended that the applicant maintains a register of events and when they start/ finish so that the use of the site can be monitored and there is a record against which to assess any complaints that may be received in respect of its use. The applicant is also recommended to consider some form of traffic management on event days – for example, possible direction by staff of traffic into and out of the access onto Yock Lane, and the use of pickup/drop off points at or near public car parks in Pershore by any form of shared transport such as a minibus, so that residential areas are not affected by parked vehicles of those attending events.
The applicants attention is drawn to the fact the 2022 application submissions included a Bat Survey that found evidence of roosting bats in the roof tiles of one of the barn wings. Because of the presence of bats, a European Protected Species Licence is required before any works can be undertaken to these buildings. It was noted in the determination of that application that a low impact licence could, however, be applied for by a suitably qualified Ecologist because of the small number of bats found to be present. It is understood that none of the works now applied for should affect any of the Bat Survey recommendations, although the applicant is advised to confirm this with Natural England.
