Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Plan 1 - Location Plan Plan 2 A - Site Layout Plan Plan 3 - Paladin Wood fencing Plan 4 - Plan and Elevations Plan 5 - Plan and Elevations Plan 6 - Wire Mesh Fence Elevations Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The Development hereby approved shall not commence until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to: • Temporary traffic management arrangements, including details of how the safe and normal flow of the adjoining A38 will be ensured during the construction phase, with particular attention to how this will be ensured when the crane required to lift the Battery Box into place is being utilised. • Clarity regarding the construction phase site access proposals, including details of any temporary construction accesses and their reinstatement. • Details of site operative parking areas, material storage areas and the location of site operatives’ facilities (offices, toilets etc). • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring. • Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway. • Vehicle routing. • Mitigation for impacts on residents. • Key contact details, including an emergency telephone number. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved in writing by the Local Planning Authority. REASON: To ensure the provision of adequate on-site facilities and in the interests of highway safety in accordance with SWDP4 & SWDP21, and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until an appropriate quantum of off-street vehicle parking for Battery Box maintenance vehicles is provided. The details of the area allocated for maintenance vehicle parking shall first be submitted to and approved in writing by the Local Planning Authority. These parking facilities shall be kept clear of obstruction and retained only for the parking of maintenance vehicles in connection with operating and maintaining the Battery Box. REASON: To ensure the provision of adequate on-site facilities and in the interests of highway safety with SWDP4 & SWDP21, and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the commencement of development, a comprehensive Risk Management Process shall be undertaken by the operator to identify hazards and risks specific to the facility and to develop, implement, maintain and review appropriate risk controls. From this process, a robust Emergency Response Plan (ERP) shall be prepared and submitted to the Local Planning Authority. The ERP shall include, but not be limited to, the following matters: • Identification and management of hazards and risks specific to the siting, infrastructure, layout, and operation of the facility. • Assessment of impacts on surrounding communities, buildings, and infrastructure. • Siting of renewable energy infrastructure to eliminate or reduce hazards to emergency responders. • Safe access for emergency responders throughout the site, including to energy storage and firefighting infrastructure. • Provision of adequate water supply and firefighting systems to enable safe and effective emergency response. • Vegetation management to avoid increased bushfire and grassfire risk. • Measures to prevent fire ignition on-site. • Measures to prevent fire spread between site infrastructure (including solar panel arrays, wind turbines, and BESS units). • Measures to prevent external fire sources impacting site infrastructure. • Provision of accurate, current, and readily accessible information for emergency responders during incidents. • Site-specific emergency planning and management protocols aligned with the facility’s operational profile. The approved ERP and associated mitigation measures shall be implemented in full prior to first operation of the development and shall be maintained and reviewed throughout the operational lifetime of the facility. Reason: To ensure that adequate measures are in place for risk identification, mitigation, and emergency response, in the interests of fire safety, public safety, and the protection of surrounding communities and infrastructure.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
