Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location Plan - Scale 1:1250 Block Plan - Scale 1:500 Reason: To define the permission in accordance with policies SWDPR01 and SWDPR03 of the South Worcestershire Development Plan Review 2026 and the National Planning Policy Framework.
The use of the land hereby approved shall be for domestic equestrian purposes only and shall not be used for any commercial or business purposes, including livery, riding school or equestrian events. Reason: To ensure that the scale and intensity of the use remains appropriate to the site and its rural location, and to safeguard the character and appearance of the area, residential amenity and highway safety, in accordance with Policies SWDPR03, SWDPR34, SWDPR35 and SWDPR54 of the South Worcestershire Development Plan Review.
No groundworks shall take place until a programme of archaeological monitoring (watching brief) has been submitted to and approved in writing by the Local Planning Authority. The approved programme shall be implemented in full during any ground disturbance associated with the use hereby permitted. Reason: To ensure that any archaeological remains are appropriately identified and recorded in accordance with Policies SWDPR09 and SWDPR33 of the South Worcestershire Development Plan Review and paragraphs 207 and 218 of the National Planning Policy Framework.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), or any Order revoking and re-enacting that Order with or without modification, no buildings, structures, enclosures, hardstandings or other operational development associated with the equestrian use shall be erected or carried out on the land without the prior grant of planning permission. Reason: To enable the Local Planning Authority to retain control over future development in the interests of safeguarding the character and appearance of the area, residential amenity and archaeological interests, in accordance with Policies SWDPR03, SWDPR34, SWDPR35 and SWDPR33 of the South Worcestershire Development Plan Review.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
The applicant must be aware of their obligations as follows: No disturbance of, or change to, the surface of the path or part thereof should be carried out without written consent (this includes laying concrete, tarmac or similar). No diminution in the width of the right of way available for use by the public. Buildings materials must not be stored on the right of way, Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public's use of the right of way. No additional barriers are placed across the right of way. The safety of the public using the right of way is to be ensured at all times. The Definitive Map is a minimum record of public rights of way and does not preclude the possibility that unrecorded public rights may exist, nor that higher rights may exist than those shown.
The applicant is encouraged to prepare and implement an equine management plan to ensure that grazing is appropriately managed and that biodiversity enhancement opportunities are maximised, in accordance with the guidance provided by the Cotswolds National Landscape Board.
