In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation. No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed by the Local Planning Authority, until requirements 1 to 4 below have been complied with: 1. Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency’s ‘Land Contamination: Risk Management’ guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place. 2. Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation. 3. The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. 4. Following completion of measures identified in the approved remediation scheme a verification report that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site. Reason: To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property, and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with policies SWDP21 and 31 of the adopted South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall not be occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards in accordance with policies SWDP21 of the adopted South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not be occupied until the vehicle parking facilities as generally shown on Drawing 24-28-200A have been provided. Reason: To ensure the free flow of traffic using the adjoining highway in accordance with policies SWDP21 of the adopted South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted should not be first occupied until drainage plans for the disposal of foul and surface water flows have been submitted to and approved by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details before the development is first brought into use. Reason: To ensure that the development is provided with a satisfactory means of drainage as well as reduce the risk of creating or exacerbating a flooding problem and to minimise the risk of pollution in accordance with policies SWDP21, 28 , 29 and 31 of the adopted South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Planning Practice Guidance and section H of the Building Regulations 2010 detail surface water disposal hierarchy. The disposal of surface water by means of soakaways should be considered as the primary method. If this is not practical and there is no watercourse available as an alternative, other sustainable methods should also be explored. If these are found unsuitable satisfactory evidence will need to be submitted before a discharge to the public sewerage system is considered. No surface water is to enter the foul or combined water systems by any means.
The applicant should note that for the use or reuse of sewer connections either direct or indirect to the public sewerage system they will be required to make a formal application to Severn Trent Water Ltd under Section 106 of the Water Industry Act 1991. They may obtain copies of STW's current guidance notes and application form from either its website (www.stwater.co.uk) or by contacting the Developer Services Team (Tel: 0800 707 6600). Before undertaking any work on site, all applicants must determine if STW has any assets in the vicinity of the proposed works. This can be done by accessing its records at www.digdat.co.uk STW advise that even if its statutory records do not show any public sewers within the area specified, there may be sewers that have been recently adopted under The Transfer of Sewer Regulations 2011. STW's records indicate that there are no assets that may be affected by this proposal, however it is the duty of the site owner to confirm this is the case before any work takes place. Public sewers and Water mains have statutory protection and may not be built close to, or diverted without consent, consequently the applicant must contact STW to discuss their proposals. STW will seek to assist in finding a solution which protects both the public sewer and the proposed building.
