| Before 12 months from the date when any of the dwelling houses hereby permitted are first occupied, the land shown as green space on the approved plan (Drg No. 2024-008 Rev. 2, titled ‘Amenity and Garden Plan’) shall be laid out in accordance with the details shown on the approved plans.
Reason - To define the permision and ensure the provision of adequate green space in accordance with policy SWDP39 of the South Worcestershire Development Plan 2016 and relevant aims and objectives of the National Planning Policy Framework.

| Plot 1 shall not be occupied until its associated car parking provision and vehicle turning space as generally shown on drawings reference 2024-007 3 Highways Arrangement Plan; and 2024-005 3 Parking and EV Plan, and have been implemented. This area shall thereafter be retained for the purpose of parking a vehicle only.
Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway, in accordance with the relevant aims and objectives of the South Worcestershire Development Plan 2016 and relevant aims and objectives of the National Planning Policy Framework. |
| Plot 1 shall not be occupied until visibility splays are provided from a point 0.6m above carriageway level at the centre of the site access to the private drive / application site and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 2 metres in each direction measured along the nearside edge of the adjoining carriageway and offset a distance of 0.6m from the edge of the carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above.
Reason: To ensure highway safety in accordance with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan 2016 together with compliance with the Worcestershire Streetscapes Design Guide 2022 and the aims and objectives of the National Planning Policy Framework.

| No dwelling hereby approved shall not be occupied until the vehicular access at Newland Lane, as shown in the approved plan (Drg No. 2024-002 Rev. 3, titled ‘Planning Layout’) has been widened to a minimum width of 5.5 metres and the private drive provided at a minimum width of 5.0 metres, to the written satisfaction of the Local Highway Authority.
Reason: To ensure conformity with summited details in the interests of highway safety in accordance with Policies SWDP4 and SWP21 of the South Worcestershire Development Plan 2016 and in accordance with the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of the development hereby approved, including the removal of any structures on the site, the existing trees, shrubs and hedges on the site shall be protected by fencing constructed in accordance with BS 5837:2012 (trees in relation to design, demolition and construction - recommendations). These protection measures will be retained throughout the development of the site in the approved positions as set out within the submitted Tree retention plan (submitted 26.12.24 ) .
Reason: To protect the existing trees and hedges to be retained on the site during construction work and to preserve the amenities of the locality in accordance with policies SWDP21 and SWDP22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.

| No dwelling hereby approved shall be occupied until provision shall be made within the site for the sustainable disposal of surface water / inclusive of SUDS.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.

| The materials to be used in the construction of the external surfaces of the dwellings hereby permitted shall be in accordance with the submitted materials schedule and in accordance with the approved plan (Drg No. 2024-003 Rev. 3, titled ‘Material Plan’).
Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.

| Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no additions, extensions or external alterations, new windows or other openings, building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwelling house, other than those specified within this permission, shall be constructed/carried out on the application site following the completion/first use of the development hereby permitted.
Reason: To ensure an appropriate final development in the interest of protecting the character of the locality in accordance with Policy 21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Before the development hereby permitted is first occupied, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on.
Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan. and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The development shall be carried out in accordance with the details and findings in the Preliminary Ecological Appraisal by Dr Stefan Bodnar Dated September 2023 as originally submitted under W/23/02540/TDC5.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the first occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority.
The landscaping scheme shall include:-
(i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.
All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.
The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 and to provide biodiversity enhancements in accordance with SWDP22 of South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| No drainage to Discharge to Highway
Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway.
Section 278
The granting of this planning permission does not remove any obligations on the applicant to undertake a technical design check of the proposed highway improvement works with the Highway Authority (Worcestershire County Council, WCC), nor does it confirm detailed design approval by the Highway Authority until the design check process has been concluded. Upon the satisfactory completion of the technical check the design would be suitable to allow relevant conditions imposed under this permission to be discharged but works to the public highway cannot take place until a legal agreement under Section 278 of the Highways Act 1980 has been entered into to allow the works and the applicant has complied with the requirements of the New Roads and Streetworks Act 1991 (NRSWA) and Traffic Management Act 2004. The person or organisation shall follow the necessary procedure by applying to WCC Streetworks Team for road space for a period to be agreed.

| Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible.
However, birds can nest at any time and the site including any buildings should ideally be checked for their presence immediately before work starts. |
| Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species.
It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant. |
