| The application site is located within Flood Zones 2 and 3. In the absence of a detailed flood risk assessment, insufficient information has been submitted for the Local Planning Authority to make a fully informed assessment of the flooding impacts of the proposal, including whether the risk of flooding would be increased elsewhere or whether the development is safe from flooding for its lifetime Equally, the submission does not carry out a sequential test which considers other 'reasonably available' sites, failing to demonstrate that there are no other sequentially preferable alternative sites for the proposed development that lie within Flood Zone 1. Therefore, the proposal would not comply with local or national planning policy which seeks to steer new development away from areas at the highest risk of flooding and minimise the risk of flooding elsewhere. The proposal would be contrary to Policy SWDP 28 of the South Worcestershire Development Plan in addition the relevant aims and objectives of the National Planning Policy Framework, including paragraphs 173, 174 and 175 in respect of the sequential test. |
| By virtue of the proposed siting, scale and design, in particular the orientation, layout of the plot and architectural detailing of the proposed dwelling, the development would not be sympathetic to or respond appropriately to the local character and pattern of development in the area. As a result, the development would appear incongruous in its location and harmful to the local character of the area. The development is accordingly contrary to Policy SWDP21 of the South Worcestershire Development Plan and the relevant aims of the National Planning Policy Framework. |
| The proposed dwelling and detached garage would be within two metres of the watercourse which runs along the southern and western edges of the site. The development therefore fails to maintain a sufficient access strip adjacent to the top of the watercourse’s bank for maintenance purposes. There are no exceptional circumstances which suggest that this reduced distance would be acceptable. The development is therefore contrary to Policy SWDP28(E)(ii) of the South Worcestershire Development Plan. |
| In the absence of a legal agreement to secure the dwelling as a self and custom build dwelling, the development is not exempt from biodiversity net gain requirements under Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021). The application has not been supported by a biodiversity net gain assessment including: the pre-development biodiversity value of the on-site habitat or the completed metric calculation. The development subsequently fails to make appropriate provision for biodiversity gain. Accordingly, it would conflict with the relevant aims and objectives of the National Planning Policy Framework, and Schedule 7A of the Town and Country Planning Act 1990. |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
| In the absence of a secure mechanism to provide a financial contribution towards the provision of off site affordable housing, the proposal would conflict with Policy SWDP15 of the South Worcestershire Development Plan and would fail to meet the social objectives of sustainable development as set out in the National Planning Policy Framework. |
