Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 762-111 762-112A 762-113A 762-114A Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
Prior to the development hereby permitted first being occupied, sheltered and secure cycle parking to comply with the Council’s adopted Worcestershire's Streetscape Design Guide shall be implemented and shall not thereafter be used for any other purpose. Reason: In the interests of providing adequate cycle parking provision within the curtilage of the dwelling house in accordance with SWDP4 & SWDP21 and the aims and objectives of the National Planning Policy Framework (NPPF).
Before the first occupation of the building hereby permitted the first floor windows on the side elevations shall be fitted with Pilkington Level 4 obscured glazing or equivalent and shall be permanently retained in that condition thereafter. Reason - To protect the amenities of adjoining/nearby properties from unacceptable overlooking/loss of privacy and represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Before the first use/occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected shall be submitted to and approved in writing by the local planning authority The boundary treatment shall be completed before the first use/occupation of the development hereby permitted]. Development shall be carried out in accordance with the approved details. Reason - To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan..
Prior to the occupation of the development hereby permitted, the parking and turning area as shown on drawing 762-12 shall be provided. Such parking spaces shall be kept clear of obstruction and retained only for the parking of vehicles in connection with the use of each property as a dwellinghouse. Reason: To ensure that satisfactory provision is made for the parking of vehicles off the highway at all times in line with SWDP4 & SWDP21, as well as the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in accordance with the Energy Statement. Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
This permission does not authorise the Applicant to create or amend a vehicular crossing over a footway or verge within the public highway or to gain access to the public highway. Prior to any works commencing to install the dropped kerb, the Applicant must apply for and obtain a S184 Licence under the Highways Act 1980. The Applicant is responsible for all costs associated with a S184 Licence application and the construction of the works covered by the Licence. The Contractor/ Licensee has overall responsibly for any works taking place in the public highway. All contractors working on the public highway must hold valid New Roads and Street Works Act (NRSWA) 1991 work cards.
