Condition Details / Information Notes
Unless where required or allowed by other conditions attached to this permission the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: Location Plan Scale 1:1250, Proposed Block Plan Scale 1:500, drw no 10808-01. Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The development hereby permitted and as shown on the approved plans listed under Condition 1 of this Decision Notice shall be used for holiday accommodation only (and shall not be occupied as a person or persons’ sole, or main place of residence) and for no other purpose including any other purpose within Class C of the Schedule of the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. Reason: Having regard to Policy SWDP1, SWDP2, SWDP4, SWDP21, and SWDP25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework the local planning authority are not prepared to allow the introduction of permanent unrestricted residential development on the basis of how the application has been submitted and assessed, having regard to the settlement pattern and character and appearance of the countryside hereabouts. Furthermore the proposed unit/visitor accommodation would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed unit/accommodation is only acceptable as a holiday let/ tourism development in accordance with Policy SWDP12 and SWDP35 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP2 and SWDP12 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No person or group of persons shall occupy the holiday accommodation hereby permitted for more than 28 days consecutive days at a time and no same person or group of persons shall occupy the accommodation for more than 156 days in any one calendar year. The owners/operators of the site shall maintain an up-to date register of the names of all occupiers of the accommodation and of their main home address (i.e. place of residence) and shall make this information available at all reasonable times to the Local Planning Authority. Reason: To ensure that the development hereby permitted is used for the specific use applied for, to prevent unrestricted residential development and in the interests of ensuring a sustainable pattern of development that also does not unduly increase reliance on the private motor vehicle, in accordance with polices SWDP1, SWDP2, SWDP4 SWDP21 and SWDP25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework, and furthermore the proposed unit/accommodation is only acceptable as a holiday let/ tourism development in accordance with Policy SWDP12 and SWDP35 of the South Worcestershire Development Plan.
Within 4 months of the date of this permission the first 5m of the access into the development, measured from the edge of the carriageway, shall be surfaced in a bound material. Reason: In the interests of highway safety in accordance with Policy SWDP21 of the South Worcestershire Development Plan (2016) and the relevant aims and objectives of the National Planning Policy Framework.
Within 4 months of the date of this permission an area shall be laid out within the curtilage of the holiday accommodation unit for the parking of 2 cars at a gradient not exceeding 1 in 8. This area shall thereafter be retained for the purpose of parking a vehicle only. Reason: In the interests of highway safety in accordance with Policy SWDP21 of the South Worcestershire Development Plan (2016) and the relevant aims and objectives of the National Planning Policy Framework.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
