| The development shall be carried out in strict accordance with the materials shown on the approved plans as listed under Condition 2 of this Decision Notice only unless otherwise agreed in writing with the Local Planning Authority prior to any substitution or variation being made.
Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.

| The Development hereby approved shall not be brought into use until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.

| The Development hereby approved shall not be brought into use until each of the Accessible Parking spaces shown on Drawing No. 4589-02H have minimum dimensions measuring 4.8 metres in length and 3.6 metres in width.
REASON: To ensure conformity with the stipulations for Blue Badge Holder Parking set out within the adopted Worcestershire County Council Streetscape Design Guide and in accordance with SWDP 4 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to installation, detailed drawings and specifications of the photovoltaic (PV) panels to be installed on the buildings shall be submitted to and approved in writing by the Local Planning Authority. The details shall include the type, size, location, orientation, appearance and the extent to which the PV panels will project or extend beyond the plane of the building’s roof.
The development shall be carried out strictly in accordance with the approved details.
Reason: To ensure a satisfactory form of development and that the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policy SWDP21 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.

| Within six months of any of the solar panels/photovoltaic panels hereby permitted or as approved under Condition 9 of this Decision Notice becoming redundant, inoperative or permanently unused, those panels and all associated infrastructure shall be removed and re-used, recycled, the materials recovered, or be finally and safely disposed of to an appropriate licensed waste facility, in that order of preference.
Reason: To ensure a satisfactory form of development, avoid any eyesore from redundant plant despoiling the countryside/ streetscene and its character and appearance, prevent pollution, and safeguard the environment when the materials reach their end of life, in accordance with Policies SWDP1, SWDP21 and SWDP31 and the relevant aims and objectives of the National Planning Policy Framework. |
| The applicant should note the National Planning Policy Framework by the Ministry of Housing, Communities and Local Government, particularly paragraph 105, to ensure that planning policies protect and enhance public rights of way. We wish to draw your attention to Public Right of Way (PRoW) Hanbury HB-696 which crosses your property. The legal obligations are listed below.
The safety of the public using the rights of way is to be ensured at all times. The Definitive Map is a minimum record of public rights of way and does not preclude the possibility that unrecorded public rights may exist, nor that higher rights may exist than those shown.
Work undertaken to carry out the development should not obstruct the footpath at any time. However, if public safety demands a temporary
closure, application should be made at least 6 weeks in advance, unless an emergency situation arises, by contacting PROWclosures@worcestershire.gov.uk.
Any PRoW surfaces disturbed during the development must be reinstated to their original condition or to a specification agreed in advance by this
department. This should not be taken as permission to disturb the surface intentionally.
Vehicular access is coincident with the definitive line of Hanbury HB-696 therefore the applicant should make themselves satisfied that any vehicle using the existing access has a right to do so. It may be prudent to seek legal advice on the matter because under section 34 of the Road Traffic Act 1988, any person who drives a motor vehicle on a public right of way, without lawful authority, commits an offence.
The grant of planning consent does in no way entitle developers to obstruct a public right of way. No additional barriers can be placed across the rights of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority.
There must be no diminution in the width of the rights of way available for use by the public.
No disturbance of, or change to, the surface of the paths or part thereof should be carried out without the written consent of the PROW team (this includes laying concrete, tarmac or similar). The County Council is responsible for maintaining rights of way only to a standard suitable for their usual public use. Therefore any damage to the surface of the PRoW and repairs of such must adhere to Highway Authority
specifications.
Buildings materials must not be stored on the rights of way.
Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public’s use of the rights of way.
