The submitted Water Management Statement does not fully justify any adequate measures within these proposals for dealing with surface water drainage and is therefore contrary to the adopted South Worcestershire Development Plan Review (March 2026) Policies SWDPR 38 Management of Flood Risk, SWDPR 39 Sustainable Drainage Systems and SWDPR 40 Water Resources, Efficiency and Wastewater Treatment, and the relevant aims and objectives of the National Planning Policy Framework.
Refused - Residential Amenity
The proposed increase in activity on this site and increased use of a narrow road by large vehicles e.g. horse boxes and / or horse trailers, in close proximity to adjacent dwellings may have a detrimental impact on existing residential amenity, contrary to the adopted South Worcestershire Development Plan Policies SWDPR 35 and SWDPR 54 and the aims and objections of the National Planning Policy Framework.
Refused - Site Access conflict with drainage
Vehicular traffic from the development should be able to access the highway safely from the site, but the proposed vehicular access conflicts with an existing drainage channel and therefore these proposals are contrary to the adopted South Worcestershire Development Plan Review Policies SWDPR 28 and SWDPR 54 and the relevant aims and objectives of the National Planning Policy Framework.
Refused - Equestrian Development
The proposal would not meet any criteria set out within the adopted South Worcestershire Development Plan Review Policy SWDPR 54 Equestrian Development or the relevant aims and objectives of the National Planning Policy Framework. By virtue of its design, location and the lack of supporting information regarding management of the site and waste, the scheme would represent an inappropriate, overly domestic addition to this open countryside location contrary to policies SWDPR 28, SWDPR 05 and SWDPR34.
The Reasoned Justification in paragraph 54.3 explains that regard should also be had to Equine Industry Guidelines in the preparation of equestrian development proposals to ensure that development is fit for purpose, in that it provides sufficient land to allow for the appropriate care of horses, including stabling, grazing and exercise. The applicant has not demonstrated any knowledge of such requirements for this purpose.
Refused - Effective management of manure
There are insufficient details proposed in the effective management of manure on-site contrary to SWDPR 54 Equine Development.
These proposals further do not meet the criteria in accordance with SWDPR 40 Water Resources, Efficiency and Wastewater where proposals need to demonstrate that they will not propose unacceptable deterioration to water quality, or an unacceptable impact on water quality by ensuring that development does not have a detrimental impact on the flow or quantity of groundwater; water quality of surface or groundwater; or unacceptable harm to biodiversity.
These proposals are also contrary to the relevant aims and objectives of the National Planning Policy Framework and in particular paragraph 198.
Refused - North Littleton Legal Agreement – Flood Prevention Scheme
There is a signed legal agreement between Wychavon District Council and the site landowner titled ‘North Littleton Legal Agreement – Flood Prevention Scheme’ which is a document that commits the landowner to maintain the flood works paid for and installed by Wychavon District Council upon the land. These flood alleviation works currently safeguard adjacent properties from being flooded. This is a material consideration with significant weight applied to it.
This proposed development is contrary to the drainage requirements that need to be maintained, and that which are secured under the legal agreement North Littleton Legal Agreement – Flood Prevention Scheme and therefore this proposal would affect the flood risk of adjacent properties, contrary to the adopted South Worcestershire Development Plan Review (March 2026) Policies SWDPR 38 Management of Flood Risk, SWDPR 39 Sustainable Drainage Systems and SWDPR 40 Water Resources, Efficiency and Wastewater Treatment, and the relevant aims and objectives of the National Planning Policy Framework.
In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably.
The Council has however been unable to seek solutions to problems arising from this application as the principal of the proposal is considered contrary to our statutory policies and legal agreement and negotiation would not overcome that reason for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
