Condition Details / Information Notes
The proposed development, by virtue of its physical appearance represents poor quality design that fails to respect the character and appearance of the surrounding area and fails to conserve or enhance the significance of the Evesham Conservation Area. As such, the proposed development would not integrate effectively with its surrounding and would fail to reinforce local distinctiveness. The proposed development would result in less than substantial harm to this designated heritage assets and the public benefits of the proposal do not outweigh the identified harm. Overall, the proposal would be contrary to Policies SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the National Planning Policy Framework (December 2024).
By virtue of the proximity of the seating area as proposed to residential windows serving habitable rooms at Nailers Row, the development would increase impacts of noise and disturbance to the residents, with the potential for any such impacts to be harmful. In the absence of any information regarding the noise levels or any mitigation to manage noise levels during hours of use, insufficient information has been submitted to demonstrate that the development would not lead to a harmful noise impact upon the neighbouring residential amenity. The development is therefore contrary to paragraph 198 of the National Planning Policy Framework (December 2024) and Policy SWDP 31 of the South Worcestershire Development Plan 2016.
By virtue of the proximity of the seating area as proposed to residential windows serving habitable rooms at Nailers Row, the development would increase the frequency and duration of people smoking, with the potential for emissions to detrimentally impact upon the air quality and residential amenity of those neighbours. The development is therefore contrary to paragraph 198 of the National Planning Policy Framework (December 2024) and Policy SWDP 31 of the South Worcestershire Development Plan 2016.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by seeking further information and amendments following receipt of the application and by considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
