Condition Details / Information Notes
The development hereby permitted shall be begun before 26 June 2028. Reason: Having regard to the date the original related planning permission (reference W/24/01689/FUL) and to conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials and boundary treatments) provided on the application form and the following plans/drawings/documents: - Location Plan 1580 - 101 - dated 22/08/24 - Landscape Masterplan 0002 Rev A - dated 22/08/24 - BLOCK PLAN AS PROPOSED 1580-112M (as approved under W/25/01371/NMA) - Proposed Site Plan 1580-114R – Received 25/6/2025 - PLANS AND ELEVATIONS AS PROPOSED 1580-115Z - Received 17/7/2025 Reason: In order to define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
No development shall begin until a Construction Environment Management Plan (CEMP) has been submitted to and approved in writing by the Local Planning Authority. The CEMP shall include the following details:- a. details to minimise the impact of noise, vibration and dust from construction, demolition and site clearance activities and the traffic associated with this development, including a scheme for vehicle wheel cleaning and other measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway. b. details of site operative parking areas, material storage areas and the location of site operative facilities (offices, toilets etc); c. restrictions on burning; d. hours of site clearance, demolition, construction, and deliveries; e. construction exclusion zones to prevent soil compaction in areas to be planted and remediation proposals for any soil compaction which does occur; f. a strategy for the handling and storage of topsoil; g. a management strategy and proposals for the minimisation of construction waste; h. details of any temporary construction accesses and their reinstatement; i. where the development site includes a public right of way, measures to manage and maintain safe use of the right of way by the public and avoid or minimise the need for temporary closure. The measures set out in the approved Plan shall be carried out and complied with in full during the demolition and construction phase of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved in writing by the Local Planning Authority. Reason: To protect the existing amenity of the area from the unreasonable effects of noise, vibration, light and dust nuisance, to avoid and mitigate for any potential impact on protected species, minimise the risk of accidents and ensure public rights of way are kept available where possible for the duration of the construction, in accordance with Policies SWDP4, 21 and 22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall not be occupied used until full details of all surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Foul water connection shall be carried out in accordance with the approved plans listed under Condition 2 of this Decision Notice prior to the first occupancy of the dwelling hereby permitted. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Before the development hereby permitted is first occupied, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework (NPPF) and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the access arrangements and area as shown on the approved plans listed under Condition 2 of this Decision Notice has been laid out, providing for the parking of 3 cars at a gradient not exceeding 1 in 8. This area shall thereafter be retained for the purpose of parking a vehicle(s) only and the access area (shown hatched on Drawing number 1580-112M; BLOCK PLAN AS PROPOSED 1:500 as approved under reference W/25/01371/NMA) from Chapel Lane shall remain unobstructed at all times. REASON: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway and to comply with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved, shall be carried out in accordance with the submitted implementation programme. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Notwithstanding the provisions of article 3(1) and Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015,(or any order revoking or re-enacting that Order with or without modification), no development which would otherwise be permitted under Classes A, B, C, D, E and H of Part 1 and of Schedule 2, shall be carried out. Reason: In order to protect the character and amenity of the locality, to maintain the amenities of adjoining property, having regard to the high design and architectural merit of the development hereby permitted and to comply with Policy SWDP1, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
