Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: PV1/101 P-4, PV1/105 P-4, PV1/110 P-2, PV1/111 P-2, PV1/112 P-2, PV1/115 P-4, PV1/120 P-2, PV1/121 P-2, PV1/130 P-2, PV1/140 P-2, PV1/141 P-2, PV1/150 P-5, PV1/151 P-5, PV1/160 P-3, S-7251 Habitat Baseline Plan. Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The development hereby permitted shall not be occupied/first used until full details of all surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the first occupation of any of the dwellings hereby approved, details of superfast broadband facilities or alternative solutions to serve the dwellings hereby approved shall be submitted to and approved in writing by the local planning authority. The submitted details shall include an implementation programme. The facilities shall be provided in accordance with the approved details. Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
Before the first occupation of the building referred to as Dwelling A as hereby permitted the window serving the first floor ensuite on the south west facing elevation as specified on the approved plans PV1/111 P-2 and PV/120 P-2 shall be fitted with Pilkington Level 4 obscured glazing or equivalent and shall be permanently retained in that condition thereafter. Reason - To protect the amenities of adjoining/nearby properties from unacceptable overlooking/loss of privacy and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Before the first occupation of the development hereby permitted the boundary treatments of post and rail timber fencing and native hedgerow shall be implemented in accordance with the details as specified on the submitted application form and the approved Landscape Plan drawing number PV1/115 P-4. Reason: To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
All planting and seeding/turfing comprised in the submitted landscape scheme as specified on the approved Landscape Plan drawing number PV1/115 P-4 shall be carried out in the first planting season following the first occupation of the development. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any trees or plants that die, or  are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
Prior to first occupation of the development hereby approved the pv panels as specified on approved plans PV1/115 P4, PV1/140 P2 and PV1/141 P-2 shall be fully installed to demonstrate that at least 10% of the predicted energy requirements of the development will be met through the use of renewable/low carbon energy generating facilities. Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with Policy SWDP27 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
No dwelling hereby approved shall be occupied until the visibility splays for that dwelling’s access, as shown on Drawing No. PV1/150 P-5(dwelling A) or Drawing No. PV1/151 P-5 (dwelling B), have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. Reason: In the interests of highway safety and in accordance with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No dwelling hereby approved shall be occupied until the first 5m of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety and in accordance with Policy SWDP4 and SWDP21 and the relevant aims and objectives of the National Planning Policy Framework.
No dwelling hereby approved shall be occupied until the vehicle access, parking and turning facilities as generally shown on the ‘Landscape Plan’ (Drawing No: PV1/115 P-4) for that dwelling have been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all time. Reason: In the interests of highway safety and in accordance with Policy SWDP4 and SWDP21 and the relevant aims and objectives of the National Planning Policy Framework.
No dwelling hereby permitted shall be occupied until sheltered and secure cycle parking as generally shown on Drawing No. PV1/140 P-2 (dwelling A) or Drawing No. PV1/141 P-2 (dwelling B) has been provided . Reason: To comply with the Council’s parking standards in accordance with Policy SWDP4 and SWDP21 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal report carried out by Betts Ecology dated November 2024 and the Precautionary Method of Working for reptiles, common toad, hedgehogs, badgers and nesting birds and submitted with this application. To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved Habitat Management and Monitoring Plan (HMMP). Reason: To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays, Bank Holidays or Public Holidays. Reason - To preserve the amenities of the locality in accord with Policy SWDP21 and SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
This permission does not authorise the Applicant to create or amend a vehicular crossing over a footway or verge within the public highway or to gain access to the public highway. Prior to any works commencing, the Applicant must apply for and obtain a S184 Licence under the Highways Act 1980. The Applicant is responsible for all costs associated with a S184 Licence application and the construction of the works covered by the Licence. The Contractor / Licensee has overall responsibility for any works taking place in the public highway. All contractors working on the public highway must hold valid New Roads and Street Works Act (NRSWA) 1991 work cards.
The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. Subject to Paragraph 14(2) of Schedule 7A TCPA 1990 The biodiversity gain plan must include: (a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; (b) the pre-development biodiversity value of the onsite habitat; (c) the post-development biodiversity value of the onsite habitat; Advice about how to prepare a Biodiversity Gain Plan and a template can be found at https://www.gov.uk/guidance/submit-a-biodiversity-gain-plan
The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
