| The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.

| Unless indicated on the approved plan(s) to be removed, all existing trees and hedges on the application site, or branches from trees on adjacent land that overhang the application site, shall be retained and shall not be felled or pruned or otherwise removed within the construction period and then for a period of five years from the completion of the development without the previous written consent of the local planning authority.
If any retained tree/hedge is removed, uprooted or destroyed or dies, replacement planting shall be carried out in the first available planting season, in accordance with details to be approved in writing by the local planning authority.
Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policies SWDP21 and SWDP22 of the South Worcestershire Development Plan. |
| The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal report carried out by Betts Ecology, dated February 2023 and submitted with this application. In particular:
- Pre-clearance search of all areas within the site.
- Site clearance to be undertaken outside of bird nesting season.
- Ensure any steep-sided excavations are covered at night.
- Avoid unnecessary lighting at night and utilise down-lighting where possible.
- Creation of log piles, "wild" corners and native planting within the site, installation of two bird boxes and two bat boxes of mixed designs and installation of a hibernaculum on western / southern site boundary.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
| No building hereby permitted shall be occupied until details of the implementation, maintenance and management of the sustainable drainage/surface water drainage scheme as shown on the approved plans/documents have been submitted to and approved in writing by the local planning authority. Details shall include:
- a implementation timetable; and
- a management and maintenance plan for the lifetime of the development which shall include the arrangements for adoption by any public body or statutory undertaker, or any other arrangements to secure the operation of the drainage scheme throughout its lifetime.
The drainage scheme shall be implemented and thereafter managed and maintained in accordance with the approved details.
Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| No building hereby permitted shall be occupied until details of the design, implementation, maintenance and management of foul water drainage works have been submitted to and approved in writing by the local planning authority. The development shall be carried out, and the drainage maintained/managed, in accordance with the approved details.
Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment in accordance with policy SWDP30 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The external materials to be used in the construction of the dwellings hereby permitted shall be carried out in strict accordance with the Proposed Materials document prepared by Border Oak Limited, received on the 18th July 2025, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure that the development represents high quality design in accordance with Policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| No dwelling hereby approved shall be occupied until the access, parking and turning facilities have been provided as shown on drawings DP1/105 Rev P-3 and DP1/105 - P-2.
Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with SWDP4 of the South Worcestershire Development Plan.

| The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.
Reason - In the interests of highway safety, in accordance with SWDP4. |
| The Development hereby approved shall not be occupied until the proposed access gates have been set back 5 metres from the adjoining carriageway edge and made to open inwards only.
Reason: In the interests of highways safety, in accordance with SWDP4. |
| All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved, shall be carried out in the first planting season following the first occupation/use of the development.
All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment.
Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016. |
| The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein. |
| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
| Stoulton parish footpath SN-609 passes through the northern end of the application site. The applicants' attention is drawn to the following obligations in respect of the public right of way.
• The Public safety of those using the right of way must be ensured at all times.
• There must be no diminution in the width of the rights of way available for use by the public.
• There must be no change to the surface of a Public Right of Way without written consent from the authority.
• Building materials must not be stored on the rights of way.
• Vehicle movements and parking are to be arranged so as not to unreasonably interfere with the public’s use of the rights of way.
• No additional barriers are to be placed across the rights of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority.
Where possible, the definitive line of public rights of way should be kept open and available for use throughout the construction phase. However, if Public Safety demands a temporary closure, application should be made at least 8 weeks in advance to: The Public Rights of
Way Mapping Team at prowclosures@worcestershire.gov.uk. Obstructing a Public Right of Way without a formal closure constitutes an offence under the Highways Act 1980.
The applicant should note the National Planning Policy Framework, last updated 5 September 2023 by the Ministry of Housing, Communities and Local Government, particularly paragraph 100, ‘…planning policies and decisions should protect and enhance public rights of way and access, including taking opportunities to provide better facilities for users, for example by adding links to existing rights of way networks including National Trails’.
The developer should also be aware of the Department of Environment Circular 1/09 (part 7) which explains that the effect of development on a public right of way is a material consideration in the determination of applications for planning permission and that the grant of planning consent does not entitle developers to obstruct a public right of way. WCC would recommend that Public Rights of Way (PROWs), potentially affected by planned works, are clearly designated on all associated planning maps, diagrams or schematics as a matter of course. |
