The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission 20/02517/FUL dated 16.03.2022. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 72319 - D01E - Proposed Site Plan 72319 - D05A - Ground Floor Plan 72319 - D06 - First Floor Plan 72319 - D07 - Second Floor Plan 72319 - D04A - Roof Plan 72319 - D13B - Site Elevations 1&2 72319 - D14B - Site Elevations 3&4 72319 - D900B - LANDSCAPE 72319 - D15 - Proposed Site Sections Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.
Full details of any soil or soil-forming materials proposed for importation to the site for use in garden areas, soft landscaping, filling, and level raising must be submitted to the Local Planning Authority and approved in writing prior to import and implementation of the scheme, except where such details have already been approved, in which case the approved details shall remain valid. Full donor site details, proposals for contamination testing, including testing schedules, sampling frequencies, and allowable contaminant concentrations (as determined by appropriate risk assessment), must be submitted to and approved in writing by the Local Planning Authority prior to import onto the site, unless already approved. All works shall be carried out by competent persons and in accordance with the Environmental Agency’s Land Contamination Risk Management (LCRM) guidance. Reason - to ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property, and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with Policy SWDP 31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development must be carried out in accordance with the details previously approved 10186 Almonry Close Pershore Worcestershire - Scope Letter, B17372 Final Gas Monitoring Results Letter, 10186-703 PEHLP v.02, 10186-704 EHLP-704 EHLP, ACP-PPC-00-XX-RP-G-0012 - Almonry Close Pershore - Post Demo Letter Report in relation to site investigation, risk assessment, and remediation. Specifically: • The detailed site investigation and risk assessment; • The approved remediation scheme; • The implementation of the remediation measures; and • The submission and approval of the validation report Shall be undertaken as approved and completed in full prior to the occupation of any part of the development, unless otherwise agreed in writing by the Local Planning Authority. In the event that previously unidentified contamination is found during the carrying out of the approved development, it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and, where necessary, a remediation scheme prepared and implemented. Following the completion of any measures identified in the approved remediation scheme a validation report must then be submitted for approval by the Local Planning Authority prior to the occupation of any part of the development affected by the contamination unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure that the proposed development avoids significant adverse impacts from pollution in accordance with Policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in full accordance with the detailed surface water drainage design previously approved by conditions approval ref, W/25/01077/CCO dated 04.06.25, which included the cover letter dated 19.05.25, ref, 71663, DWG No. S-21-481_003 (C3) ATTENUATION TANK DETAILS, and DWG No. S-21-481_002 (C4) DRAINAGE DETAILS and shall be maintained thereafter unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out and thereafter managed and maintained in full accordance with the details previously approved by conditions approval ref, W/25/01077/CCO dated 04.06.25, which included the cover letter dated 19.05.25, ref 71663 and the SuDS Management Plan dated May 2025, ref 040A32-SMP-01 rev2. The approved plan shall be implemented in full and followed throughout the lifetime of the development unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in full accordance with foul and surface water drainage plans previously approved by conditions application, ref, W/25/01077/CCO dated 04.06.25 which included cover letter dated 19.05.25, ref, 71663 and DWG No. S-21-481_001 (C9) Drainage Layout. The approved drainage scheme shall be implemented in full prior to the first use or occupation of the development and shall be retained thereafter unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The archaeological works shall be carried out in full accordance with the Written Scheme of Investigation (WSI) and previously approved Ref: 1051679-ART69105-989-01 (00) Almonry Close Pershore WSI dated 27.04.2022 by RSK ADAS Ltd, ACP18/145 Archaeological Excavation Report by TVAS dated January 2024, Archaeolgical Excavation (Trial Trenching) Report by TVAS dated September 2023, Level 3 Historic Building Survey by ADAS, dated May 2022 and Level 3 Historic Building Survey by ADAS, dated April 2023 unless otherwise agreed in writing by the Local Planning Authority. Reason: In accordance with the requirements of paragraphs 207 and 218 of the National Planning Policy Framework (as amended) and Policies SWDP 6 and 24 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in full accordance with the details of the external materials previously approved by conditions letter dated 14.07.2022 under ref, 20/02517/FUL which included external materials schedule Lh468 Rev 1 and external works layout drawing DOC 004. These approved details include: • Type, colour, texture, size, coursing, finish, jointing and pointing of brickwork/stonework; • Type, colour texture, size and design of roofing materials; • Sample panel of brickwork and type of mortar; • Specification of proposed external render or plaster, including decorative panels or patterns, mix, number of coats, and surface finish; • Materials to be used in the walkways. The materials for the communal walled patio garden shall be constructed in accordance with DWG No. 10. The development shall be constructed in accordance with approved materials and retained thereafter unless otherwise agreed in writing by the Local Planning Authority. Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and to protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in full accordance with the landscaping scheme previously approved under ref, W/25/01077/CCO dated 04.06.2025 which included the cover letter dated 19.05 2025, ref, 71663, DWG Nos: 71663 - L(90)900 - Landscape GA and 71663 - L(90)904 - C05 - Planting Plan. All planting, seeding and turfing shall be carried out in the first planting season following the completion or first occupation or of the development, whichever is sooner, and shall be maintained thereafter in accordance with the approved maintenance schedule. Any trees or plants, within a period of five years from the completion of the planting, die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless otherwise agreed in writing by the Local Planning Authority. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be maintained in full accordance with the landscape maintenance schedule previously approved under ref, W/25/01077/CCO dated 04.06.25, which included the cover letter dated 19.05.25, ref, 71663, the Landscape Management & Maintenance Plan and Soft Landscape Specification dated April 2025, ref, 71663 by BM3. The landscape maintenance schedule shall be fully implemented and adhered to for the duration of the specified period unless otherwise agreed in writing by the Local Planning Authority. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The construction of the development shall be carried out in full accordance with the Construction Environmental Management Plan (CEMP), Rev A and the CEMP Plan 1 and 2 previously approved under Ref: 20/02517/FUL dated 03.08.22. All measures identified in the approved plan shall be implemented in full and maintained throughout the construction period. Site operatives’ parking, material storage, and placement of facilities shall be confined to locations specified within the approved CEMP unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the provision of adequate on-site facilities and to prevent indiscriminate parking and in the interests of highway safety in accordance with Policies SWDP4 and SWDP 21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Construction and delivery vehicle routing associated with the development shall be carried out in full accordance with the details previously approved under ref, 20/02517FUL dated 03.08.22, which included Construction Phase Environmental Management Plan and the CEMP Plan 1 and 2. The developer shall ensure that all construction and delivery vehicles comply with the approved routing throughout the construction period unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of highway safety in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
External lighting installed on the site shall be in full accordance with the details previously approved under Ref W/25/00761/CCO dated 25.04.25 which included DWG No. GBSC-2403-E500-P2 External Lighting Site Layout. No other external lighting shall be installed unless otherwise agreed in writing by the Local Planning Authority. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policy SWDP21 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in full accordance with the details of the bat roosting feature, including the implementation timetable, as previously approved under ref 20/02517/FUL dated 19.08.2022, which included the Ecological Mitigation Strategy by Middlemarch Environmental RT-MME-154185-01 Rev B (EMS). The bat roosting feature shall be installed in accordance with the approved details and timetable and retained thereafter unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in full accordance with the details of the superfast broadband facilities and the implementation programme previously approved under Ref W/25/00761/CCO dated 25.04.25, which included: PU_00M - OPENREACH FIBRE NETWORK. The approved broadband infrastructure shall be installed and made operational in accordance with the approved programme and retained thereafter unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in full accordance with the floor slab level details) previously approved under Ref: 20/02517/FUL dated 09.08.22, which included DWG No. 004 P2 External Works Layout unless otherwise agreed in writing by the Local Planning Authority. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policy SWDP21 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in full accordance with the Ecological Mitigation Strategy (EMS) RTMME-154185-01 Rev B (EMS) previously approved under Ref: 20/02517/FUL dated 19.08.22. Upon completion of the development, a qualified ecologist shall inspect the site and submit a statement of conformity to the Local Planning Authority, confirming that all approved ecological mitigation measures have been implemented as specified unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The resident tea making facility shall only be open to residents from 0800 hours to 1800 hours Monday to Saturday and 0900 to 1600 hours on Sundays, Public and Bank Holidays. There shall be no deliveries to the store outside of opening times unless otherwise agreed in writing by the Local Planning Authority. Reason:- To ensure the proposal preserves residential amenity and to prevent unacceptable noise pollution to the detriment of human health contrary to policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
