Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Red Line Plan (received by the Local Planning Authority 25/07/2025) Block Plan (received by the Local Planning Authority 25/07/2025) Existing Plans 001 Proposed Plans 002 Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The materials to be used in the construction of the external surfaces of the development herby permitted shall match those used in the existing building. Reason - To ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the site access, as generally shown on Drawing 240982-RAP-XX-XX-DR-TP-5000 has been completed and is open for use by vehicular traffic. REASON: In the interest of highway safety and to ensure safe and suitable access for all users and in accordance with Policy SWDP4 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the visibility splays shown on Drawing 240982-RAP-XX-XX-DR-TP-3200 P01 measuring 2.4m x 33m southwest and 2.4m x 36.5m northeast have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. REASON: In the interests of highway safety and in accordance with Policy SWDP4 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the vehicle parking and turning facilities as shown on Drawing 240982-RAP-XX-XX-DR-TP-5000 have been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times. REASON: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway and in accordance with Policy SWDP4 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until sheltered and secure cycle parking to comply with the Council’s adopted cycle parking standards has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. REASON: To comply with the Council’s parking standards and in accordance with Policy SWDP4 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby permitted shall not be first occupied until a full Travel Plan has been submitted to and approved in writing by the Local Planning Authority. The Travel Plan shall include but not be limited to: • the identification of targets for trip reduction and modal shift for employees from single occupancy car use to walking, cycling and public transport; • the measures to be implemented to meet these targets including an accessibility strategy to specifically address the needs of residents/staff with limited mobility requirements; • the timetable/phasing of the implementation of the Travel Plan and its operation thereafter for a minimum period of five years, including the responsible body for each action; •the mechanisms for monitoring and review; • the mechanisms for reporting; •the remedial measures to be applied in the event that targets are not met; •mechanisms to secure variations to the Travel Plan following monitoring and reviews; and • appointment and contact details of a travel plan coordinator. The approved Travel Plan shall be implemented, monitored and reviewed in line with the approved Travel Plan for a minimum period of five years following occupation. In the event of failing to meet the targets within the approved Travel Plan, a revised Travel Plan shall be submitted to and approved in writing by the Local Planning Authority to address any shortfalls and where necessary make provision for and promote improved sustainable forms of access to and from the site. The Plan thereafter shall be implemented and updated in agreement with the Local Planning Authority and thereafter implemented as amended. REASON: To reduce single occupancy car travel and to encourage and promote sustainable and active transport and travel and in accordance with Policy SWDP4 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The school shall operate only between the hours of 09:00 and 15:00 for students, and between 07:45 and 15:30 for teaching staff Monday to Friday inclusive. At no time shall there be more than 15 students and 6 staff members present on site. Reason: To ensure the development does not result in unacceptable harm to residential amenity, highway safety or the character of the area, in accordance with SWDP4 and SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The premises shall be used for Class F1(a) and for no other purpose, including any other purpose in Class F of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. Reason: To ensure control is retained over the type of use of the premises in the open countryside on the basis of the application submission and its assessment, and in the interests of amenity, appropriate land uses, and sustainability so to comply with South Worcestershire Development Plan Policies SWDP2, SWDP2, SWDP4, and SWDP37 and the relevant aims and objectives of the National Planning Policy Framework.
Alteration of Highway to Provide New or Amended Vehicle Crossover This permission does not authorise the Applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The Applicant is solely responsible for all costs associated with construction of the access. Travel Plan Requirements Worcestershire County Council has published guidance on how it expects travel plans to be prepared, this guidance is freely available from the County Councils Travel Plans Officer.
The applicant must be aware of their obligations as follows: No disturbance of, or change to, the surface of the path or part thereof should be carried out without written consent (this includes laying concrete, tarmac or similar). No diminution in the width of the right of way available for use by the public. Buildings materials must not be stored on the right of way, Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public's use of the right of way. No additional barriers are placed across the right of way. The safety of the public using the right of way is to be ensured at all times. The Definitive Map is a minimum record of public rights of way and does not preclude the possibility that unrecorded public rights may exist, nor that higher rights may exist than those shown.
