Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location Plan Indicative layout Block Plan Proposed Plans and Elevations (J1009064-12) Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The development hereby approved shall only be for private use and activities, and shall not be used for or in connection with any trade, business or equestrian enterprise whatsoever. Reason - To ensure that the development hereby permitted is used for the specific use applied for, to prevent unrestricted economic development and in the interests of ensuring a sustainable pattern of development, in order to protect the amenity of the area, and to ensure development does not unduly increase reliance on the private motor vehicle, in accordance with polices SWDP1, SWDP2, SWDP4, SWDP6, SWDP21, and SWDP25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework
The development hereby approved and land edged red and blue on the plans and drawings as listed under Condition 2 of this Decision Notice shall not be sold. Let, or sublet separately from each other Reason – In the interests of sustainable development, to avoid piecemeal and unrelated development in the countryside and to comply with Policies SWDP1, SWDP2, SWDP4, SWDP12, and SWDP21 and the relevant aims and objectives of the National Planning Policy Framework.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. Subject to Paragraph 14(2) of Schedule 7A TCPA 1990 The biodiversity gain plan must include: (a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; (b) the pre-development biodiversity value of the onsite habitat; (c) the post-development biodiversity value of the onsite habitat; Advice about how to prepare a Biodiversity Gain Plan and a template can be found at https://www.gov.uk/guidance/submit-a-biodiversity-gain-plan
