| The application site lies outside of a defined settlement boundary within open countryside. The proposed development would prejudice the Council’s stated aim of focusing most development on the urban areas, where both housing needs and accessibility to lower-cost public services are greatest. Furthermore, due to the location of the application site and the lack of any direct connections to the surrounding footway network, the proposed development would be highly dependent of the use of the private motor vehicle to access everyday services and facilities. This would lead to unsustainable patterns of travel thus negatively affecting air quality, increasing congestion, and increasing carbon emissions, which contributes to climate change. The lack of any direct connections to the surrounding footway network also means that the proposal fails to address the needs of people with disabilities and reduced mobility in relation to all modes of transport and create places that are safe, secure, and attractive, which minimise the scope for conflict between pedestrians, cyclists, and vehicles. The proposal development therefore conflicts with Policies SWDP2 and SWDP4 of the South Worcestershire Development Plan and paragraphs 115 and 117 of the National Planning Policy Framework (December 2024). Furthermore, the proposal would undermine wider Government aims and objectives including Net Zero and Carbon emission targets. |
| In the absence of a signed Section 106 legal agreement no arrangements are in place to secure the provision of affordable housing. As such, the proposed development does not meet the objectives of sustainable development and cannot be delivered with acceptable impacts on the community. Therefore, the proposed development is contrary to Policies SWDP1 and SWDP15 of the South Worcestershire Development Plan and guidance contained within the Council’s Affordable Housing SPD. |
| Insufficient information has been provided to demonstrate that the proposed development would have an acceptable impact on biodiversity. Furthermore, it has not been adequately demonstrated that the proposal meets the legal definition of a self-build/custom house under section 1A of the Self-build and Custom Housebuilding Act 2015 (as amended). As such, it has not been demonstrated that the development is exempt from the statutory requirement to deliver Biodiversity Net Gains. In the absence of any supporting ecology information or baseline information it is therefore not possible to ascertain whether the proposal can deliver a Biodiversity Net Gain of at least 10%. The proposal therefore conflicts with Policy SWDP22 of the South Worcestershire Development Plan, guidance contained in the National Planning Policy Framework (December 2024), and Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021). |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - Considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
