| No building operations herby permitted shall commence until details of all the external materials to be used in the construction of the development shall be submitted to and approved in writing by the Local Planning Authority.
The development shall not be carried out other than in accordance with the approved details.

| No dwelling hereby approved shall be occupied until visibility splays are provided from a point 0.6m above carriageway level at the centre of the access to the application site and 2.4m back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 60m in each direction measured along the nearside edge of the adjoining carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above.

| The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.

| No dwelling hereby approved shall be occupied until the access, turning area and parking facilities shown on Drawing A1130 14 Rev C Planning Layout Plan has been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times.

| No dwelling hereby permitted shall be first occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only.
REASON: To comply with the Council’s parking standards and in accordance with Policy SWDP4 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:-
(i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.
All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.
The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Before the first use/occupation of the development hereby permitted details of a precise specification of the proposed materials for the hard landscaping of the site (including roads, paths, parking areas and other hard surfaces) shall be submitted to and approved in writing by the local planning authority. The hard landscaping of the site shall be completed before the first use/occupation of the development hereby permitted. Development shall be carried out in accordance with the approved details.
Reason - To ensure the proposed development represents high quality design and does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Before the first use/occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected shall be submitted to and approved in writing by the local planning authority The boundary treatment shall be completed before the first use/occupation of the development hereby permitted. Development shall be carried out in accordance with the approved details.
Reason - To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| The dwellinghouse hereby approved, shall not be occupied until details of renewable and/or low carbon energy generation measures are submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:-
i. the overall predicted energy requirements of the approved development;
ii. the predicted energy generation from the proposed renewable/low carbon energy measures; and
iii. an implementation timetable for the proposed measures.
The development shall be carried out in accordance with the approved details.
Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| The development hereby permitted shall not be occupied/first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter.
Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| The recommendations and precautionary measures for protection set out within Sections 4.1 and 4.3b of the Phase I Preliminary Ecological Appraisal, September 2023 revised Nov 2023 (reference: Newland0923_PEA) by Dr. Stefan Bodnar, shall be followed in strict accordance.

| The dwellinghouses hereby approved, shall not be occupied until one bird box, one house sparrow terrace and one bat box has been provided for each dwelling in accordance with Chapter 4.3a set out within the Phase I Preliminary Ecological Appraisal, September 2023 revised Nov 2023 (reference: Newland0923_PEA) by Dr. Stefan Bodnar.
Reason: To provide biodiversity enhancements in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the commencement of the development hereby approved, including the removal of any structures on the site, the existing trees, shrubs and hedges on the site shall be protected by fencing constructed in accordance with BS 5837:2012 (trees in relation to design, demolition and construction - recommendations) in accordance with the plan reference 3039-P-12 Tree Protection Plan within the ‘BS5837:2012 Arboricultural Survey & Impact Assessment’ (ref: 3039), dated December 2024 undertaken by Focus Environmental Consultants. These protection measures will be retained throughout the development of the site in the approved positions.
Reason: To protect the existing trees on the site during construction work and to preserve the amenities of the locality in accordance with policies SWDP21 and SWDP22 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Before the first occupation of Dwelling (type D), hereby permitted the wardrobe window at first floor level shall be fitted with Pilkington Level 4 obscured glazing or equivalent and be non-opening and shall be permanently retained in that condition thereafter
Reason - To protect the amenities of nearby properties from unacceptable overlooking/loss of privacy and in accordance with policy SWDP21 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the installation of any external lighting, details of such external lighting shall be submitted to and approved in writing by the Local Planning Authority. All lighting should be designed in accordance with Bat Conservation Trust / Institution of Lighting Professionals Guidance Note 08/18 Bats and artificial lighting in the UK. Submitted lighting plans should be accompanied by contour diagrams that demonstrates minimal levels of lighting on receptor habitats, including trees and hedges. Development shall be carried out in accordance with the approved details and retained thereafter.
Reason: To safeguard protected species in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016 together with Wildlife and Countryside Act 1981 and Conservation of Habitats and Species Regulations 2017 and the relevant aims and objectives of the National Planning Policy Framework. |
| Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking or re-enacting that order), no development (as defined by Section 55 of the Town and Country Planning Act 1990) as may otherwise be permitted by virtue of Class A, Class B, Class C or Class E of Part 1, Schedule 2 of the Order or Classes A or B of Part 2, Schedule 2 of the Order shall be carried out on the dwellinghouses hereby permitted.
Reason: To protect, conserve and enhance the character of the area in accordance with Policies SWDP21 and SWDP25 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
| Buildings are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the 1981 Wildlife and Countryside Act and the Habitat Regulations 1994, the latter of which deems them a European Protected Species.
It is a criminal offence to recklessly disturb or destroy a bat 'roost'. Where a bat 'roost' is present a licence might be necessary to carry out the works. Further information about species licensing and legislation can be obtained from the Species Licensing Service on 0117 3728000. If evidence of bats is found during works, work should stop immediately and Natural England must be contacted on 01453 764450 for advice on the best way to proceed. |
| Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible.
However, birds can nest at any time and the site including any buildings should ideally be checked for their presence immediately before work starts. |
| The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein. |
