Condition Details / Information Notes
Insufficient justification has been provided to ensure that the construction of the boundary wall in close proximity to a mature chestnut tree that is protected by a Tree Preservation Order (TPO/W/61/05/001/TPO) would not result in damage to the tree and its roots. The risk to the tree’s long-term health, stability and amenity value is too great would mean that, and the works would conflict with both the requirements of the Tree Preservation Order and the principles of the BS5837 (2012) - Trees in Relation to Design, Demolition and Construction. The potential loss of the Chestnut tree would be harmful to the character of the area and would cause an adverse impact in terms of ecology and wildlife. The proposal is therefore contrary to policies SWDP21, SWDP22 and SWDP25 of the South Worcestershire Development Plan (February 2016) and Policy NCLE6 of the North Claines Neighbourhood Plan 2015 – 2030.

Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - considering the imposition of conditions In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
