Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission W/24/00246/FUL approved on the 7th June 2024. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Proposed Block Plan WLO/PL/01 D Existing Site Plan WLO/PL/02 Existing Ground Floor WLO/PL/03 North & South Elevations WLO/PL/04 East & West Elevations WLO/PL/05 Proposed Site Plan WLO/PL/06 F Ground Floor Plan WLO/PL/07 E First Floor Plan WLO/PL/08 E Roof Plan WLO/PL/09 D Proposed North Elevation WLO/PL/10 D Proposed East Elevation WLO/PL/11 C Proposed South Elevation WLO/PL/12 D Proposed West Elevation WLO/PL/13 C Site Sections WLO/PL/14 B Carport WLO/PL/15 Location plan (08-Feb-2024) Reason: In order to define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
No development above damp proof course level shall commence until details of the materials to be used in the construction of the external surfaces of the replacement dwelling hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include:- - type, colour, texture, size, coursing, finish, jointing and pointing of brickwork; - detailed specification of the new timber cladding showing the dimensions, profile and a description of the stain or paint finish to be applied to the cladding; - type, colour, texture, size and design of roofing materials; - external joinery details of the proposed external finishes, heads, sills, position in wall reveal and any surrounding dressings; - details of external doors including information on finish; The development shall be carried out using the materials as approved. Reason - To ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Roost Assessment report carried out by Sharpe Ecology dated January 2024 and submitted with this application. In particular: - in the unlikely event that any bat is encountered on site during the works, it should be left in situ and works should cease until an appropriate course of action has been agreed in writing with the ecologist - include the provision of 1-2 bat boxes either integrated into the new building or located on suitable trees in the garden. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No development above damp proof course level shall commence until details of renewable and low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:- - the overall predicted energy requirements of the approved development; - the predicted energy generation from the proposed renewable/low carbon energy measures; and - an implementation timetable for the proposed measures. The development shall be carried out in accordance with the approved details. Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Before the development hereby permitted is first occupied, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason - To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Buildings are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and Natural England must be contacted on 0845 6003078 for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the relevant contact details.
