| The Development hereby permitted shall not be first occupied until sheltered, secure and accessible cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only.

| The Development hereby approved shall not be occupied until an area has been laid out within the curtilage of the dwelling for the parking of 3 cars at a gradient not exceeding 1 in 8. This area shall thereafter be retained for the purpose of parking a vehicle only.

| Development shall not begin until visibility splays are provided from a point 0.6 metres above carriageway level at the centre of the access to the application site and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 120 metres for both directions measured along the nearside edge of the adjoining carriageway and offset a distance of 0.6 metres from the edge of the carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above.

| The Development hereby approved shall not be brought into use until the first 5 metres of the access into the development, measured from the edge of the carriageway has been surfaced in a bound material.

| The Development hereby approved shall not be brought into use until the access, parking and turning facilities have been provided as shown in the Proposed Ground Floor Plan (DWG ref: 2023-12-04).

| A bat box shall be installed within the land ownership of the site (e.g. Ibstock enclosed bat box, Habitat bat box, Schwegler Wall-mounted Bat Shelter 2FE, Schwegler 2F Bat Box). The box should be installed at least 4m above ground-level, and not placed above windows. The roosting feature shall be installed before the first use of any part of the development.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan |
| All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved, shall be carried out in the first planting season following the first occupation/use of the development. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment.
Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016. |
| Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
| The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein. |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:
- seeking further information following receipt of the application;
- considering the imposition of conditions and the completion of a s.106 legal agreement.
In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. |
| A S171 Licence must be obtained from Highways Network Management prior to undertaking any works or excavation of the adopted highway. |
| This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council's Approved Contractor following the issue of a license under Section 184 and 278 of the Highways Act, 1980.
The applicant should contact Worcestershire County Council's Highways Community and Response Unit, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), regarding the issue of the necessary license authorising the access works to be carried out by the County Council's Approved Contractor at the applicant's expense.
The applicant should give the County Council sufficient notice to enable, as far as possible, the licence procedure to be carried out so that there is no disruption to the applicant's programme of works. |
| The Applicant's attention is drawn to the need to ensure that the provision of the visibility splay(s) required by this consent is safeguarded in any sale of the application site or part(s) thereof. |
| Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway. |
| This decision does not permit the construction of a car port to the front of or within the curtilage of the proposed dwelling. This element of the works was removed from the previous scheme and confirmed in writing by the agent. Should the applicants wish to erect any outbuilding(s) or other structures within the domestic curtilage of the property, which would not benefit from permitted development, the relevant permission(s) should be sought from the Local Planning Authority. |
