Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Drg no. 278 Nvh 01 – Topographical Plan Drg no. 309 Nvh 02 Rev A – Site Plans Drg no. 309 Nvh 03 – Location and Block Plans Drg no. 309 Nvh 04 – Proposed Plans and Elevations Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The business or ‘work’ floorspace of the live/work unit(s) (as shown on the approved plans listed under Condition 2 of this Decision Notice) of the development hereby approved shall be used for any of Use Class E(g)(i) offices, E(g)(ii) research and development or E(g)(iii) industrial processes only and for no other purpose, including any other purpose in Class C or Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. Reason: To ensure appropriate definition and control of the development hereby permitted for clarity and the avoidance of doubt, to ensure the development provides appropriate live/work unit(s) in accordance with Policies SWDP8 and SWDP26 of the South Worcestershire Development Plan, to deliver appropriate economic development, choice and opportunity in Wychavon district’s rural areas, and to prevent incompatible or harmful land use and activity or unjustified unsustainable residential development in the countryside contrary to South Worcestershire Development Plan policies SWDP1, SWDP2, SWDP3, SWDP8, SWDP12, SWDP19, and the relevant aims and objectives of the National Planning Policy Framework.
The residential floorspace of the live/work unit(s) (as shown on the approved plans listed under Condition 2 of this Decision Notice) shall not be occupied other than by a person solely or mainly employed, or last employed in the business occupying the business floorspace of the associated unit, a widow or widower of such a person, or any resident dependants (dependants are defined as parents, grandparents, children, or grandchildren). Reason: To prevent an abuse of the planning system, and ensure appropriate definition and control of the development hereby permitted for clarity and the avoidance of doubt, to ensure the development provides appropriate live/work unit(s) in accordance with Policy SWDP8 of the South Worcestershire Development Plan, and to prevent unjustified unsustainable residential development in the countryside contrary to South Worcestershire Development Plan policies SWDP1, SWDP2, SWDP3, SWDP8, SWDP12, SWDP19, and the relevant aims and objectives of the National Planning Policy Framework.
The residential and work floorspace areas of the live/work unit(s) (as shown on the approved plans listed under Condition 2 of this Decision Notice) shall not be sold, let, or sublet separately from each other. Reason: To ensure appropriate definition and control of the development hereby permitted for clarity and the avoidance of doubt, to ensure the development provides appropriate live/work unit(s) in accordance with Policies SWDP8 and SWDP26 of the South Worcestershire Development Plan, and to prevent unjustified unsustainable residential development in the countryside contrary to South Worcestershire Development Plan policies SWDP1, SWDP2, SWDP3, SWDP8, SWDP12, SWDP19, and the relevant aims and objectives of the National Planning Policy Framework.
At the point of first occupation and use of the live/work unit(s) hereby permitted (and each subsequent occupation thereafter), the Local Planning Authority shall be notified in writing within 28 days of such occupation of the unit with the following details – • Name of the business/ company utilising the live/work unit • Nature of the business/ company • Name of the principle owner/ occupier Reason: To ensure appropriate definition and control of the development hereby permitted for clarity and the avoidance of doubt, to ensure the development provides appropriate live/work unit(s) in accordance with Policies SWDP8 and SWDP26 of the South Worcestershire Development Plan, to monitor the delivery and take up of economic development, choice and opportunity in Wychavon district’s rural areas, and to prevent incompatible or harmful land use and activity or unjustified unsustainable residential development in the countryside contrary to South Worcestershire Development Plan policies SWDP1, SWDP2, SWDP3, SWDP8, SWDP12, SWDP19, and the relevant aims and objectives of the National Planning Policy Framework.
Development shall not commence until evidence has been submitted to and approved in writing by the Local Planning Authority (LPA) demonstrating that a conservation covenant or a section 106 agreement has been entered into to provide and control the long-term management, monitoring, and enhancement of biodiversity at the off-site habitat. The conservation covenant or section 106 agreement shall ensure the delivery of the required biodiversity units for a minimum period of 30 years from the completion of the habitat enhancement works. The submitted evidence shall include a copy of the conservation covenant or section 106 agreement demonstrating that the off-site habitat is managed in accordance with the approved Biodiversity Gain Plan. Reason: To comply with the Biodiversity Gain (Town and Country Planning) (Modifications and Amendments) (England) Regulations 2024 and paragraphs 180 and 186 of the National Planning Policy Framework.
Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to its / their installation as part of the development hereby permitted, details of the external surfaces of the live/work unit shall be submitted to and approved in writing by the local planning authority. The details to be submitted shall include:- - type, colour, texture, size, coursing, finish, jointing and pointing of brickwork/stonework; - type, colour, texture, size and design of roofing materials; - a precise specification of the proposed external render or plaster – including any decorative panels or patterns – and detailed specification of the mix, the number of coats and surface finish to be used; - detailed specification of the new weatherboarding showing the dimensions, profile and a description of the stain or paint finish to be applied to the boarding: - external joinery details along with architectural details of the proposed external finishes, heads, sills, position in wall reveal and any surrounding dressings (elevational drawings at a minimum scale of 1:20 and vertical sectional drawings at minimum scale of 1:2); - details of external vents, ventilation slits, extracts and chimney flues including information on specification and colour; - details of external doors/garage doors including information on finish; The development shall be carried out using the materials as approved and thereafter be maintained in accordance with those approved details. Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The Development hereby approved shall not be occupied until the first 5m of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. REASON: In the interests of highway safety in accordance with Policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until parking is provided generally in accordance with Drawing No. 02-A (Proposed Site Plans) for the parking of 6 cars at a gradient not exceeding 1 in 8. This area shall thereafter be retained for the purpose of parking a vehicle only. REASON: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. REASON: To comply with the Council’s parking standards and to encourage sustainable modes of transport in accordance with Policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
This permission does not authorise the Applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The Applicant is solely responsible for all costs associated with construction of the access.
