| The proposal fails to meet the requirements of Paragraph MA.2(2)(d) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), as it has not been demonstrated that future occupiers would not be adversely affected by noise from surrounding commercial premises. No noise impact assessment or mitigation details have been submitted to accompany the application. The site is bound on either side and to the rear by commercial units and includes a service yard to the rear which serves a number of nearby premises, the operation of which has the potential to give rise to noise and disturbance. As such, the applicant has failed to demonstrate that the proposed residential use would provide an acceptable living environment for future occupiers, and the development would therefore result in unacceptable amenity impacts. |
| The proposal fails to meet the requirements of Paragraph MA.2(2)(e) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), as the impact of the change of use on the character of the Evesham Conservation Area has not been adequately addressed. The development would result in the loss of an established ground floor retail unit within a designated Primary Shopping Frontage, which forms an important and defining characteristic of Bridge Street and the wider conservation area. The change of use would erode the historic commercial character of the street and result in a high degree of less than substantial harm to the character and appearance of the conservation area and the setting of nearby listed buildings. As such, the proposal fails to preserve or enhance the character or appearance of the Evesham Conservation Area and does not comply with the requirements of this prior approval matter. |
| The proposal fails to meet the requirements of Paragraph MA.2(2)(f) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), as it has not been demonstrated that adequate natural light would be provided to all habitable rooms of the proposed dwelling. The submitted floor plans indicate that Bedrooms 2 and 3 would not be served by any windows, and insufficient information has been provided to demonstrate how adequate levels of natural light would be achieved, including any detailed design or justification for the proposed use of lightwells throughout the dwelling. As such, the applicant has failed to demonstrate that the proposed dwelling would provide an acceptable standard of residential accommodation for future occupiers. |
