Expansion of existing Business Centre for Class B8 open storage yards, with associated access improvements and creation of new landscape buffer (part retrospective)
The application site lies within the open countryside, outside any defined development boundary. The proposal seeks to extend the existing employment use onto additional land within the wider holding through the creation of further Class B8 open storage yard space. Insufficient information has been submitted to demonstrate a local need for the scale and type of B8 use proposed, or that this site is an appropriate location for the intended occupier and use, having regard in particular to its relationship to the surrounding area, neighbouring amenity, the local highway network and the absence of a clear strategy to minimise the use of non-renewable resources and energy. Furthermore, the proposal has not been demonstrated to represent an acceptable form of rural employment development or farm diversification. The proposal therefore conflicts with Policies SWDPR03, SWDPR14 and SWDPR15 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework .
Insufficient information has been submitted to demonstrate that the proposed expansion of the site for Class B8 open storage use can be accommodated safely on the local highway network. In particular, the application fails to satisfactorily demonstrate the likely scale and nature of vehicle movements associated with the expanded yard, the number and type of commercial vehicles likely to use or be stored on the site, the adequacy of the access arrangements, the means by which vehicles would be prevented from waiting on the public highway, or how HGV routing through Peopleton would be effectively controlled. The site is also in an unsustainable location in transport terms, lacking safe and suitable pedestrian access, meaningful cycle infrastructure and accessible public transport. As such, the proposal has failed to demonstrate that it would provide safe and suitable access, avoid unacceptable impacts on highway safety, or minimise reliance on the private car. The proposal therefore conflicts with Policies SWDPR06 and SWDPR14 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The proposal would result in the obstruction of the definitive line of Public Footpath PP-522 by reason of the siting of fencing and hedgerow planting, and no satisfactory amendment to the scheme or formal diversion of the route has been secured as part of the application. As such, the proposal fails to respond appropriately to an important site constraint and would result in an unacceptable impact on pedestrian connectivity and the public rights of way network, contrary to Policy SWDPR28 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The proposal would extend open storage use onto additional land within the wider holding, resulting in a substantial surfaced yard area, boundary fencing and the open storage of large vehicles, trailers, plant and associated paraphernalia within a rural landscape characterised by fields, hedgerows, tree cover, winding lanes and a dispersed settlement pattern. The proposed planting and boundary treatment would not satisfactorily overcome the harmful visual and character impacts arising from the extension of this commercial use into the countryside. The proposal would therefore fail to conserve the character and appearance of the area and conflicts with Policy SWDPR34 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
Insufficient ecological information has been submitted in support of the application. No ecological survey, habitat assessment or other technical evidence has been provided to demonstrate that the scheme has avoided unacceptable harm to biodiversity interests, notwithstanding the site’s rural location and the presence of ecological features within the wider area. Furthermore, no meaningful ecological mitigation, compensation or enhancement has been submitted beyond incidental landscape planting. The proposal therefore fails to demonstrate that biodiversity interests would be conserved and enhanced and conflicts with Policy SWDPR29 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
By reason of the nature of the proposed use, including the storage of plant, equipment and commercial vehicles and the associated vehicle movements, manoeuvring and yard activity, the proposal has the potential to give rise to unacceptable levels of noise, disturbance, dust, emissions and general nuisance. No robust noise assessment, air quality information, lighting details or other substantive amenity evidence has been submitted to demonstrate that the retrospective extension of the yard use would not result in unacceptable harm to the living conditions of nearby occupiers, including the adjacent care home. The proposal therefore conflicts with Policies SWDPR35 and SWDPR41 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
Insufficient information has been submitted to demonstrate, through a robust Water Management Statement, that site drainage and runoff would be managed in a sustainable and co-ordinated way or that the four pillars of Sustainable Drainage Systems would be achieved by the scheme. In particular, inadequate information has been provided in respect of water quality treatment, runoff control, amenity benefit and biodiversity benefit arising from the proposed drainage approach. The proposal therefore fails to demonstrate compliance with Policies SWDPR38 and SWDPR39 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The site has a history of potentially contaminative use, including waste-related activity. Notwithstanding this, no site investigation, contamination assessment or other technical evidence has been submitted to establish the extent of contamination within the application site or to demonstrate that the land is, or can be made, suitable for the proposed use. The proposal therefore fails to demonstrate that unacceptable risks to human health, controlled waters, property or the wider environment would be avoided, contrary to Policy SWDPR42 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably.
The Council has however been unable to seek solutions to problems arising from this application as the principal of the proposal is considered contrary to our statutory policies and negotiation would not overcome that reason for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
