Condition Details / Information Notes
The proposed development fails to demonstrate that the identified accommodation needs could not be satisfactorily met through the alteration, extension and/or refurbishment of the existing dwelling. Furthermore, when considered cumulatively, the proposal would result in a significant increase in footprint and floorspace well in excess of the 30% allowance, leading to a form of development that is disproportionately larger than the existing dwelling. In addition, the proposed replacement dwelling would not be sited on the footprint of the existing dwelling, and insufficient justification has been provided to demonstrate why an alternative siting is necessary or acceptable. Moreover, the proposal involves only the partial demolition of No. 2 and does not provide for the complete demolition of the dwelling to be replaced, contrary to the requirements for replacement dwellings. For these reasons, the proposal fails to comply with Policy SWDP 18 of the South Worcestershire Development Plan. As a result, the development represents an inappropriate form of development in the open countryside, contrary to Policy SWDP 2 of the South Worcestershire Development Plan (2016) and the relevant aims and objectives of the National Planning Policy Framework.
In the absence of a legal agreement to secure the dwelling as a self and custom build dwelling, the development is not exempt from biodiversity net gain requirements under Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021). As such, the development subsequently fails to make appropriate provision for biodiversity gain and would have an adverse effect on biodiversity and would be contrary to Policy SWDP22 of the South Worcestershire Development Plan (2016), the relevant aims and objectives of the National Planning Policy Framework, and Schedule 7A of the Town and Country Planning Act 1990.
