Condition Details / Information Notes
Policy SWDPR 03 The Spatial Development Strategy and Settlement Hierarchy sets out in Part D that ‘The Open Countryside is defined as land beyond any defined Development Boundary, where development will be strictly controlled subject to other policies in the Plan’. This policy is given significant weight as the recently adopted SWDPR Local Plan and SPD policies including a 5 year housing land supply with 20% buffer can be demonstrated, and needs to be upheld where material conditions do not amount to a deviation from this position. This proposal is a clear contradiction to the SWDPR Plan and therefore this proposal is refused.
The development would somewhat erode the rural character of the site through the introduction of residential development sited outside of the development boundary and extends development outwards to the east of the village with increased vehicular movements and the new introduction of built form. The Worcestershire Landscape Character Assessment places the site within the Tibberton Settled Farmlands with Pastoral Land Use Character Area which is characterised as having a rolling lowland topography with a settlement pattern being of farmsteads and wayside dwellings associated with a moderate to high level of dispersal and a small to medium scale of field pattern. The proposed development would expand the settlement beyond the existing and planned boundaries of Tibberton in an approach which is neither in accordance with the settlement hierarchy nor that does it respond adequately to its context. Overall, the development does not safeguard the character and openness of the open countryside and is considered to conflict with the aims and objectives of SWDPR 03 The Spatial Development Strategy & Settlement Hierarchy; SWDPR 28 Design; SWDPR 34 Landscape Character; The Worcestershire Landscape Character Assessment and the Wychavon Design Code SPD (June 2026) resulting in landscape harm to such a degree that justifies this refusal.
To ensure that the site can be adequately drained, the Drainage Engineers have requested the submission of infiltration test results to confirm if soakaways are acceptable. If infiltration cannot be achieved further details must be provided showing the correct attenuated discharge to the nearby watercourse. No development shall take place until a percolation test has been carried out in accordance with BRE Digest 365, (or such other equivalent guidance as may be agreed in writing by the Local Planning Authority) and the results of the percolation test to be submitted to and agreed in writing by the Local Planning Authority. No infiltration data has been submitted and therefore this proposed drainage strategy is contrary to SWDPR 38 Management of Flood Risk; SWDPR 39 Sustainable Drainage Systems; and SWDPR 40 Water Resources, Efficiency & Wastewater Treatment.
No details have been submitted for the provision nor monitoring of Biodiversity Net Gain and so these proposals are contrary to the aims and objective of the SWDPR 30: Biodiversity Net Gain.
In the absence of a Section 106 legal agreement, no secure arrangements are in place to secure the provision of and arrangements for the provision and monitoring of Biodiversity Net Gain (BNG) As such, the proposed development does not meet the objectives of sustainable development and cannot be delivered with acceptable impacts on the community and the environment. Therefore the application is contrary to adopted South Worcestershire Development Plan Review SWDPR30 as well as guidance contained in the National Planning Policy Framework.
