Condition Details / Information Notes
The application fails to demonstrate that the live/work unit accommodation would operate as a genuine live/work unit. The submitted layout does not provide a functional or independent workspace that is clearly seperate from the residential accommodation. In particular, the formation of a direct internal connection via a shared hall between the residential and employment areas result in the two uses functioning as a single mixed-use dwelling, rather than distinct 'live' and 'work' elements. The proposal therefore fails to comply with the requirements of Policy SWDP 8 (Part G) of the South Worcestershire Development Plan which seeks to ensure that live/work units provide clearly defined, self-contained and independent workspaces in order to secure their use for genuine employment purposes. Furthermore, in regard to the emerging South Worcestershire Development Plan Review, the application would not be located within or adjacent to a Town or Category 1,2 or 3 village. The applicant has also failed to provide sufficient details of the business, including evidence to demonstrate that it has been economically viable and in operation for a minimum period of three years. In addition, the proposal shows that the residential and employment floorspaces are not integrated within a singular building and as such, the scale and form of development are not considered appropriate to it's location and setting. The proposed residential floorspace would also exceed 100 square metres and, as set out above, the scheme fails to provide an independent workspace that is clearly separate from the residential accommodation. The proposal therefore fails to comply with the requirements of Policy SWDPR 15(Part C) of the emerging South Worcestershire Development Plan Review. As such, the proposal does not satisfy the requirement of Policy SWDP 8 (Part G) of the South Worcestershire Development Plan, 2016 and the emerging Policy SWDPR 15 (Part C) of the South Worcestershire Development Plan Review and cannot benefit from the exemption provided in Policy SWDP2 of the South Worcestershire Development Plan, nor Policy SWDPR 3 of the emerging South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The application site is located within the open countryside in a location that is poorly related to local services, facilities and sustainable transport options. As a result, future occupiers would be highly dependent upon the private motor vehicle for access to employment, services and amenities, leading to an increase in unsustainable journeys. The proposal therefore represents an unsustainable form of development in terms of its location. The development is therefore contrary to Policies SWDP1, SWDP2, SWDP4 and SWDP8 of the South Worcestershire Development Plan, Policies SWDPR3, SWDPR6 and SWDPR15 (C) of the South Worcestershire Development Plan Review, which directs live/work units to locations within or adjacent to a Town or Category 1, 2 or 3 Village, and Chapter 9 of the National Planning Policy Framework, which seeks to minimise the need to travel and promote genuinely sustainable transport choices.
Insufficient information has been submitted to enable the Local Planning Authority to assess the impact of the development on heritage assets of archaeological significance within the site. The site is known to contain non-designated heritage assets, including historic farmstead buildings such as a threshing barn and shelter shed, as well as potential ridge and furrow earthworks and a possible house platform. A Neolithic hand axe was also recorded at Island Barn in 1958, indicating the potential for significant archaeological remains within the site. The application is partially retrospective and groundworks have already been undertaken without appropriate archaeological investigation, mitigation or historic building recording. In the absence of a heritage statement, desk-based assessment, archaeological evaluation, or building recording, the Local Planning Authority is unable to properly assess the significance of the heritage assets or the impact of the development upon them. The proposal therefore fails to comply with Policies SWDP6 and SWDP24 of the South Worcestershire Development Plan, Policies SWDPR09 and SWDPR33 of the emerging South Worcestershire Development Plan Review and Chapter 16 'Conserving and enhancing the historic environment' of the National Planning Policy Framework, in particular paragraphs 207, 216 and 218.
