Condition Details / Information Notes
The works to which this Listed Building Consent relates must be commenced before the expiration of three years beginning with the date of this consent. Reason: To conform with the requirements of Section 18 of the Planning (Listed Buildings and Conservation Areas) Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Design Access Statement_The Row.pdf Heritage Statement_The Row.pdf Water Management Statement Roof Photos_The Row.pdf p2025_021_06 p2025_021_01 p2025_021_03 p2025_021_02 Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Prior to their installation as part of the development hereby approved, details of the following shall be submitted to and approved in writing by the local planning authority:- - Details of any replacement roof tiles, ridge tiles. This should include both material details and side-by-side photos of the new materials adjacent to the historic. The purpose of this is to demonstrate that the tile is a good match for the origional in terms of material, size, shape camber etc. The development shall be carried out using the materials as approved. Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
Birlingham Parish f footpath BL-519 runs adjacent to the location site of this application, please see the illustrative map enclosed. The proposal should have no detrimental effect on the public right of way, provided that the applicant adheres to the following obligations: • The Public safety of those using the right of way must be ensured at all times. • There must be no diminution in the width of the rights of way available for use by the public. • There must be no change to the surface of a Public Right of Way without written consent from the authority. • Building materials must not be stored on the rights of way. • Vehicle movements and parking are to be arranged so as not to unreasonably interfere with the public’s use of the rights of way. • No additional barriers are to be placed across the rights of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority. Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2017, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. Consent for works does not provide a defence against prosecution under these Acts. If bats or any signs of their presence are found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.
