| The development hereby approved shall be carried out in accordance with the updated surface water drainage drawings and calculations (drawing numbers 6191-1051 P2, 1052 P2, 1055 P1 and 1056 P2 and the Surface Water Map/Results) received on 10 October 2025 and approved in relation to planning consent W/24/01159/FUL. Future home owners or occupiers of the dwellings shall be informed about the arrangements for maintenance of communal surface water drainage assets. | The development hereby approved shall be carried out in accordance with the Nott Group Contaminated Land and Geotechnical Assessment dated 19 May 2025 and approved in relation to planning consent W/24/01159/FUL. This follows on from the submission of the Phase 1 Contaminated Land report submitted in relation to the previous planning application W/22/00467/FUL. In the event that contamination is found at any time when carrying out the approved development that was not previously identified, it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and, where necessary, a remediation scheme must be prepared and submitted to the Local Planning Authority for approval. | The development hereby approved shall be carried out in accordance with the amended Habitat Management and Monitoring Plan (the HMMP) details received on 8 October 2025 and approved in relation to planning consent W/24/01159/FUL. Notice in writing shall be given to the Council when the habitat creation and enhancement works as set out in the HMMP have been completed. The created and enhanced habitat specified in the approved HMMP shall thereafter be managed and maintained in accordance with the approved HMMP. Monitoring reports shall be submitted to the Local Planning Authority in writing in accordance with the methodology and frequency specified in the approved HMMP. | The development hereby approved shall be carried out in accordance with the Landscape Ecology and Archaeology Service Construction Environmental Management Plan (CEMP) details received on 23 September 2025 and approved in relation to planning consent W/24/01159/FUL, unless otherwise agreed in writing by the Local Planning Authority. | Prior to the construction of any part of the dwellings above floor slab level, details of the materials to be used in the construction of the external surfaces of the dwellings shall be submitted to and approved in writing by the Local Planning Authority. In addition, before the first use of the car park or playing field, both the school pathway link and pedestrian link along the access road to Hacketts Lane shall be provided as per drawing 161U. There shall be no vehicle or pedestrian link through the site from Jarrvis Street to the school pathway link or Hacketts Lane. Reason: To ensure that a safe school pathway link and pedestrian link along the access road to Hacketts Lane can be provided to the car park and playing field in a timely way as part of the site's development in accordance with Policy SWDP 4 of the South Worcestershire Development Plan and policy SWDPR 06 of the South Worcestershire Development Plan Review, as well as the relevant aims and objectives of the National Planning Policy Framework. |
| The construction work on the playing field hereby approved shall not be commenced until the precise ground levels relative to the existing development on the boundary of the application site, and any necessary supporting features such as bunds, ditches or retaining walls have been submitted to and approved in writing by the Local Planning Authority. Thereafter the playing fields shall be constructed in accordance with the approved details and retained in that form. Reason: Because the land slopes and to ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan and policies SWDPR 05, 28, 34 and 35 of the South Worcestershire Development Plan Review, as well as the relevant aims and objectives of the National Planning Policy Framework. |
| The development hereby approved shall not be first occupied until site access visibility splays are provided in accordance with the details illustrated in drawing number SK03 revision A; any foliage or other obstruction falling within the visibility splays should be cut back/re-planted/re-positioned behind the visibility splays or maintained at/not exceed 0.6m in height relative to the level of the site access. | The development hereby approved shall not be occupied until a Residential Travel Welcome Pack promoting sustainable forms of access to the development has been submitted to and approved in writing by the Local Planning Authority. The pack shall be provided to each resident at the point of occupation thereafter. Reason: To reduce vehicle movements and promote sustainable access in accordance with Policy SWDP21 of the South Worcestershire Development Plan and policies SWDPR 05, 28 and 35 of the South Worcestershire Development Plan Review, as well as the relevant aims and objectives of the National Planning Policy Framework. |
| Before the first use/occupation of the development hereby permitted, a plan indicating the positions, design, materials and type of boundary treatments including gaps for hedgehogs to be erected shall be submitted to and approved in writing by the Local Planning Authority. The boundary treatments shall include an acoustic fence including details of its height, design, extent and surface density along the eastern boundary of the proposed residential development with the adjacent playing field. The boundary treatments shall be completed in accordance with a timetable agreed in writing by the Local Planning Authority and retained in that form thereafter. Reason: To (i) protect the amenities of properties, (ii) ensure the proposed development does not have an adverse effect on the character and appearance of the area, and (iii) ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site in accordance with policies SWDP21, SWDP22, SWDP25 and SWDP31 of the South Worcestershire Development Plan and policies SWDPR 05, 28, 29, 30, 34, 35 and 42 of the South Worcestershire Development Plan Review, as well as the relevant aims and objectives of the National Planning Policy Framework. |
| Before the development hereby permitted is first occupied/used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. | Prior to the occupation of any part of the development hereby permitted details of renewable or low carbon energy generating facilities to be incorporated as part of the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall demonstrate that at least 10% of the predicted energy requirements of the development will be met through the use of renewable/low carbon energy generating facilities. The approved facilities shall be provided prior to any part of the development hereby permitted being first occupied or in accordance with a timetable submitted to and approved by the Local Planning Authority as part of the details required by this condition. | Prior to the first occupation of the dwellings hereby permitted, details of refuse storage facilities to serve the development and/or each of the buildings hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. The approved refuse storage facilities shall be implemented prior to the first occupation of the associated development and/or building(s) and retained thereafter. | Before their installation, details of any new entrance gates into the application site from the existing school grounds shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the entrance gates shall be constructed in accordance with the approved details and retained in that form. | The development shall be carried out in accordance with the DJOGS Ltd Planting Plan - 1 Rev 3. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion of the development, with the open space to be provided prior to the first occupation of 50% of the dwellings in the development. The planting shall be maintained in accordance with the approved schedule of maintenance. | The development hereby approved shall be carried out in accordance with the Rappor Construction Traffic Management Plan dated April 2025 unless agreed otherwise with the Local Planning Authority. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety in accordance with Policy SWDP21 of the South Worcestershire Development Plan and policies SWDPR 05, 28 and 35 of the South Worcestershire Development Plan Review, as well as the relevant aims and objectives of the National Planning Policy Framework. |
| The development to which this permission relates shall be carried out in accordance with the following plans and drawings unless otherwise approved in writing by the Local Planning Authority (in consultation with WCC Highways): • Access Arrangement Jarvis Street drawing number SK02 revision D; and • Access Arrangement Hacketts Lane drawing number SK03 revision A. | Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00 Monday to Friday and 08.00 and 13.00 on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays. Reason: To preserve the amenities of the locality in accordance with Policy SWDP21 of the South Worcestershire Development Plan and policies SWDPR 05, 28 and 35 of the South Worcestershire Development Plan Review, as well as the relevant aims and objectives of the National Planning Policy Framework. |
| The playing fields hereby approved shall not be used outside the hours of daylight and in any case not outside the hours of 0900 to 2000. The car park hereby approved shall not be used outside the hours of 0800 to 2000. Reason: To ensure the proposal preserves residential amenity and to prevent unacceptable noise pollution to the detriment of human health contrary to policies SWDP21 and SWDP31 of the South Worcestershire Development Plan and policies SWDPR 05, 28, 35 and 42 of the South Worcestershire Development Plan Review, as well as the relevant aims and objectives of the National Planning Policy Framework. |
| The development hereby approved shall be carried out in accordance with the DJOGS Ltd Landscape and Ecological Management Scheme Plan in terms of the types and locations of bat, bird and hedgehog boxes/fence gaps and log piles. The ecological measures shall be retained thereafter unless agreed otherwise in writing by the Local Planning Authority. | The approved Biodiversity Gain Plan shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved Habitat Management and Monitoring Plan (HMMP). | Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts. Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development. This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan and policies SWDPR 05, 28, 34 and 35 of the South Worcestershire Development Plan Review, as well as the relevant aims and objectives of the National Planning Policy Framework. |
| Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no extensions or building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwelling house [other than those expressly authorised by this permission] shall be constructed/carried out on plots 1, 2, 5 and 6 as shown on Ritchie and Ritchie Architects drawing number 7789_160P, following the completion of these plots. Reason: The dwellings are manageable or retirement homes under Policies H1, H9 and JS1 of the Eckington Neighbourhood Plan 2020 and are intended to be smaller dwellings. |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - providing pre-application advice; and - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. |
| The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition "(the biodiversity gain condition") that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the Local Planning Authority, and (b) the Local Planning Authority has approved the plan. Subject to Paragraph 14(2) of Schedule 7A TCPA 1990, the biodiversity gain plan must include: (i) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; (ii) the pre-development biodiversity value of the onsite habitat; (iii) the post-development biodiversity value of the onsite habitat; (iv) any registered offsite biodiversity gain allocated to the development and the biodiversity value of that gain in relation to the development; (v) any biodiversity credits purchased for the development; and (vi) any such other matters as the Secretary of State may by regulations specify. | The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), which has been completed in relation to the related application W/24/01159/FUL and the obligations/restrictions imposed therein. |
| This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council's Approved Contractor following the issue of a license under Section 184 and 278 of the Highways Act, 1980. The applicant should contact Worcestershire County Council's Highways Community and Response Unit, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), regarding the issue of the necessary license authorising the access works to be carried out by the County Council's Approved Contractor at the applicant's expense. The applicant should give the County Council sufficient notice to enable, as far as possible, the licence procedure to be carried out so that there is no disruption to the applicant's programme of works. |
| The applicants attention is drawn to the comments of Hereford and Worcester Fire and Rescue Service on the apllication as follows: Fire Service Vehicle access should comply with the requirements of ADB 2019 Vol. 1 B5, section 13 & Table 13.1. In particular, there should be Fire Service vehicle access for a Fire Appliance to within 45 metres of all points inside dwelling houses. Access road and hardstandings to be in accordance with ADB 2019 Vol. 1 Table 13.1 Deadend access routes longer than 20m require turning facilities. Water for firefighting purposes should be provided in accordance with: ' National guidance document on the provision of water for fire - fighting' and BS 9990". |
