Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location Plan PBV 1 Block Plan PBV 2 Existing Plan (received by the Local Planning Authority 4th February 2026) Proposed Plans (received by the Local Planning Authority 20th February 2026) Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The materials to be used in the development hereby approved shall match those of the existing building in type, colour, and finish, and shall accord with the details shown on the approved plans listed in Condition 2. Reason - To ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan,2016 and the emerging Policy SWDPR 28 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall not be occupied/first used until full details of all surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan,2016 and the emerging Policies of the South Worcestershire Development Plan Review (namely SWDPR 38 & SWDPR 39) and the relevant aims and objectives of the National Planning Policy Framework.
Prior to occupation/ first use of the development hereby permitted, details of a bird nesting box shall be submitted to and approved in writing by the Local Planning Authority.  The details to be submitted shall include an implementation timetable. The feature shall be provided in accordance with the approved details and in accordance with the approved timetable. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan,2016 and the emerging Policy SWDPR 29 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as The Old Coal Yard. The development shall not be used as an independent self contained dwelling separate from the dwelling known as The Old Coal Yard. Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan and as a separate dwelling house in this location would not represent sustainable development and be contrary to the development location strategy set out in policy SWDP2 of the South Worcestershire Development Plan,2016 and the emerging SWDPR 3 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no (restricted works)(additions, extensions or external alterations) (new windows or other openings) (building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwelling house) shall be constructed/carried out on the application site following the completion/first use of the development hereby permitted. Reason: To ensure the amenity of the site and surrounding area are preserved and neighbouring amenity is not adversely impacted in accordance with SWDP21 of the South Worcestershire Development Plan,2016 and the emerging SWDPR 28 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
