| Planning permission was originally granted for the erection of a dwelling on this site because of the agricultural circumstances appertaining at that time. The site is outside any recognised limits of any settlement and therefore the Local Planning Authority would have resisted any new residential development on the site not considered essential for the proper running of the agricultural holding. It is considered that the marketing of the property is incomplete since it has not been offered for sale with the associated agricultural land, or any buildings on the site. Consequently, it remains unproven that there is no demand for the dwelling with its associated land and buildings by someone who would comply with the occupancy condition. In addition, the dwelling has only been offered for sale at a significantly lower price than the initial asking price for less than 6 months of the marketing period and during a time when the applicant acknowledges that there has been a downturn in the housing market generally. In these circumstances, it is considered that none of the arguments advanced for the removal of the agricultural occupancy condition provide sufficient justification to do so. Consequently, the removal of it would undermine the policy of restricting new residential development in rural areas contrary to policies SWDPR 03 and 24 D of the South Worcestershire Development Plan Review (2026). |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; and - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
