By virtue of its scale, design and use as well as its siting, the proposed outbuilding would not be considered acceptable from a design and heritage perspective. As such, the proposal would cause a moderate to high degree of less than substantial harm to the setting and significance of Grade 1 Listed Buildings Heron's Tower, Westwood House and Grade 2 Listed Westwood Park & Gardens. The public benefits identified would not outweigh this harm.
The proposal would not accord with the conservation and design aims of policies SWDPR 05, SWDPR 09, SWDPR 29 and SWDPR 33 of the South Worcestershire Development Plan Review (2026). The proposal is also not considered to meet the requirements of the National Planning Policy Framework including chapters 12 and 16 as well as Section 66 of the Planning (Listed Buildings and Conservation Areas) Act 1990.

Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:
- providing pre-application advice;
- seeking further information following receipt of the application;
In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
