Condition Details / Information Notes
Due to imposition of condition no. 5 on planning permission W/13/01610/PN which restricts the use of the building to only being used to store agricultural equipment for use on the applicant's land and for the shelter of livestock, this prevents the change of use of the agricultural building to dwellinghouses (C3 use) as specified by Article 3(4) of the Town and Country (General Permitted Development) (England) Order 2015, as amended. As such the proposal does not constitute permitted development under the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, (as amended) Schedule 2, Part 3, Class Q,
Due to the lack of information submitted by the applicant to demonstrate the building was used as part of an established agricultural unit as a goat milk production enterprise and due to the substantive evidence that demonstrates that the building and land has been used for the stabling of horses for non agricultural use, the applicant has failed to provide a sufficient level of evidence to demonstrate that the building did form part of an established agricultural unit on the 24 July 2023. Therefore, the proposal is not permitted development under the criteria of Paragraph Q.1 (a) part (i), Schedule 2, Part 3, Class Q, of the Town and Country Planning (General Permitted Development) (England) Order 2015, (as amended)
To comply with the criterion the existing building must be able to demonstrate that it is already capable of conversion and the applicant has failed to provide a sufficient level of information such as an in depth Structural Report or Construction Method Statement to confirm the extent of the building works required. However, notwithstanding the lack of information on the building works and level of new materials that would be required, it is evident due to the rudimentary construction and appearance of the existing building that it would not be of a solid construction that would easily allow its conversion to dwellinghouses without the requirement of substantial building works. In particular, due to the submitted proposed elevation plans, it is evident that the building could not be converted without the construction of a new wall along the north elevation with a substantial amount of glazing panels and new materials would be required to make the dwellings weathertight due to the existing building comprising of Yorkshire boarding along the remaining three walls. This would go beyond reasonably necessary and would require extensive building works that would go beyond the threshold of conversion and would constitute a rebuild. The updated guidance at Paragraph 105 Reference ID: 13-105-20180615 clearly states that "it is not the intention of the permitted development right to allow building work which would go beyond what is reasonably necessary for the conversion of the building to residential use and it is only where the existing building is already suitable for conversion to residential use that the building would be considered to have the permitted development right." As such, in this case the existing building is not already suitable for conversion and would not have the permitted development right to comply with Paragraph 105 Reference ID: 13-105-20180615 of the Planning Practice Guidance and would require an extensive overhaul that would go beyond more than partial demolition and substantial building works that would go beyond the remit of what would be reasonably necessary for the proposed conversion. Therefore, the proposal does not comply with Class Q Paragraph Q1 (j) (i) & (ii) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
The applicant should be aware that the application was determined on the following refused drawings - 202517-001, 2025017-005, 2025017-009, 2025017-007.
