Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – L01 - Existing Ground Floor Plan L02 – Existing 1st. Floor Plan L03 – Proposed Grd. Floor Plan L04 – Proposed 1st Floor Plan E01 – Existing Elevations – 1 of 2 E02 – Existing Elevations – 2 of 2 E03 – Proposed Elevations - 1 of 2 E04 – Proposed Elevations – 2 of 2 LP01 – Existing location Plan LP02 – Proposed Location Plan BP01 – Existing Block Plan BP02 – Proposed Block Plan Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016 and policy SWDPR38 and SWDPR39 of the emerging South Worcestershire Development Plan Review.
Prior to the first use / occupation of the development hereby approved, a bird box ( e.g. sparrow terrace, Schwegler 1b, vivaro pro Seville, vivaro pro Barcelona) shall be installed within the land ownership of the site. There should be clear flight path to the box without any clutter directly in front of the entrance. Nest boxes for tits, sparrows or starlings should be fixed two to four metres up a tree or a wall. Open-fronted boxes for robins and wrens need to be low down, below 2m, well hidden in vegetation. Bird boxes should face between north and east to avoid strong sunlight. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and policy SWDPR29 of the emerging South Worcestershire Development Plan Review.
Bat Informative Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their roost sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2017 (as amended), the latter of which deems them a European Protected Species. It is a criminal offence to damage or destroy a roost (even if bats are not occupying the roost at the time), to deliberately kill or injure a bat, disturb a bat in its roost, or intentionally or recklessly obstruct access to a bat roost. Planning consent for a development does not provide a defence against prosecution under these acts. Any removal of roof and wall coverings including roof tiles, slates, hanging tiles, timber boarding, timber window frames, soffit boxes and fascia boards shall be carried out carefully by hand. If bats or any sign of bats, such as accumulation of droppings are encountered at any stage of the work, work must cease immediately and advice sought from an appropriately licenced bat ecologist on how to proceed lawfully. All contractors working on site should be made aware of the advice and provided with contact details of a relevant ecological consultant. Bird Informative The applicant is reminded that, under the Wildlife and Countryside Act 1981, as amended (section 1), it is an offence to remove, damage or destroy the nest of any wild bird while that nest is in use or being built. Planning consent for a development does not provide a defence against prosecution under this act.
