Condition Details / Information Notes
The application site lies outside any defined development boundary and is therefore located within the open countryside for planning policy purposes. In this location, development is strictly controlled in accordance with Policy SWDPR03 of the South Worcestershire Development Plan Review. By virtue of the siting of a new detached dwelling in this location, the proposal would represent an inappropriate form of development in the open countryside, having regard to the spatial strategy, the Settlement Hierarchy classification of Kinsham, the site’s locational sustainability and the character of the surrounding area. The proposal is therefore contrary to Policy SWDPR03 of the South Worcestershire Development Plan Review and Policy NP1 of the Bredon Parish Neighbourhood Plan.
The proposal, by virtue of its siting, footprint, domestic form, contemporary appearance and associated domestication of the site, including the introduction of an independent residential planning unit and the associated hard surfacing, boundary treatments, parking, patio space, bin storage and other incidental domestic features, would fail to integrate effectively with its surroundings and would erode the contribution that the site currently makes to the character and open appearance of the area. The development would also fail to conserve or enhance the landscape setting of this part of Kinsham and would fail to take adequate account of Key View VK2. The proposal is therefore contrary to Policies SWDPR28 and SWDPR34 of the South Worcestershire Development Plan Review and Policies NP3 and NP15 of the Bredon Parish Neighbourhood Plan.
The application site lies immediately adjacent to the Kinsham Conservation Area and contributes to its setting. By virtue of the siting of a new detached dwelling, together with the associated domestic paraphernalia and works arising from the creation of an independent residential planning unit, the proposal would erode the openness and character of the site and would fail to preserve the setting of the Kinsham Conservation Area. The proposal would therefore result in less than substantial harm to the significance of the Kinsham Conservation Area, and the limited public benefits arising from the provision of a single dwelling are not considered sufficient to outweigh that harm. The proposal is therefore contrary to Policies SWDPR09 and SWDPR33 of the South Worcestershire Development Plan Review, the statutory duty under section 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990, and the relevant provisions of the National Planning Policy Framework.
In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however been unable to seek solutions to problems arising from this application as the principal of the proposal is considered contrary to our statutory policies and negotiation would not overcome that reason for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
