Condition Details / Information Notes
The application site falls primarily within Flood Zones 2 and 3 (the medium and high risk zones respectively) of the River Avon (statutory main river) and as such is identified at high risk of flooding.
The National Planning Policy Framework at paragraphs 173 to 175 states that the aim of the Sequential Test is to steer new development to areas at the lowest probability of flooding (Zone 1). Only where there are no reasonably available sites in Flood Zones 1 or 2 should sites in Flood Zone 3 be considered. The Council considers that there are alternative sites where residential development can be carried out that lie outside high flood risk areas. Consequently, the proposal fails the Sequential Test.
In addition, the proposal fails the Exception Test because:
- it does not provide any wider sustainability benefits to the community that outweigh flood risk, and
does not demonstrate that the development will be safe for its lifetime, without increasing flood risk elsewhere, and will not reduce flood risk overall.
As such, the proposal is contrary to Policy SWDPR 38 parts A and B of the South Worcestershire Development Plan Review (March 2026) that confirms a sequential approach to site design should be used to minimise flood risk, by placing the most vulnerable development types in the lowest flood risk areas of the site in line with the relative aims and objectives of National Planning Policy to minimise flood risk and in particular section 14 of the Framework Meeting the challenge of climate change, flooding and coastal change and guidance within the PPG.

In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably.
The Council has however been unable to seek solutions to problems arising from this application as the applicant has failed to provide a scheme that would comply with the statutory policies of the development plan and would not overcome the reasons for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
