Condition Details / Information Notes
The application site lies outside the SWDPR settlement development boundary of Lower Moor as defined in the adopted South Worcestershire Development Plan Review SWDPR 03. The site location is therefore defined as being within ‘open countryside’ where development is strictly controlled subject to other policies in the Plan as specified within SWDPR 03. The principle for housing development comprising of open market dwellings on this site is not established by any of the other housing policies listed within the South Worcestershire Development Plan Review (March 2026). The proposal is contrary to Policy SWDPR 03 Parts D and E of the South Worcestershire Development Plan Review (March 2026) including Annex D Settlement Hierarchy and the relevant aims and objectives of the National Planning Policy Framework. Development outside of a defined settlement boundary on land that is not previously developed on infilling between dwellings is also contrary to NPPF Policy S5: Principle of Development outside Settlements. Development densities of less than 30 dwellings per hectare (this proposal is for 18.5 dwellings per hectare) are not in accordance with SWDPR NPPF Policy L3: Achieving Appropriate Densities, nor in accordance with SWDPR Policy 16 Effective Use of Land, nor in accordance with Wychavon Design Code Policy 43 (D). It is concluded that the location of the site is not suitable for residential development and that the proposal, considered comprehensively, fails to represent appropriately located and articulated sustainable development of a suitable density, contrary to the adopted South Worcestershire Development Plan Review (SWDPR), Wychavon Design Code, and National Planning Policy Framework (NPPF).
The decision notice relates to the Drawing titled ‘Location Plan’ submitted 3 March 2026
In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however been unable to seek solutions to problems arising from this application as the applicant has failed to provide a scheme that would comply with the statutory policies of the development plan and would not overcome the reasons for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
