Condition Details / Information Notes
All facilities for the bulk storage of oils or chemicals, including their emptying and filling points, shall be located within a sealed bunded area. Reason: To minimise the risk of pollution of rivers and watercourses and other surface waters in accordance with Policy SWDPR42 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The visibility splays at all points of access and egress to the public highway, as approved on 28th January 2005 under planning reference W/01/1700/PN shall be retained in perpetuity. Reason: In the interests of highway safety, in accordance with Policy SWDPR6 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The 'market kiosk' building shall be used for Class A1 (retail uses) and for no other purpose. Reason: To preserve the amenities of the locality and to control the development hereby approved and for the avoidance of doubt and in accordance with Policy SWDPR28 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The secondary entrance to the store onto Gurneys Lane on the west elevation at its southern end shall be freely available to customers at all times during the store opening hours. Reason: For the avoidance of doubt and to ensure full integration of the store to the pedestrian square in Gurneys Lane to provide access and egress for pedestrians and encourage linked trips to High Street and in accordance with Policy SWDPR6 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The car park hereby approved shall be operated as a public pay and display car park unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure that the car park is freely available to all town centre users and in accordance with SWDPR6 and SWDPR28 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
Servicing of the retail store hereby permitted shall only take place between the hours of 2am and midnight, Mondays to Saturdays, including bank holidays and from 2am and 9pm on Sundays and the measures set out in the submitted 'Quiet Delivery Procedures – Delivery Management Plan' (dated March 2026) shall be implemented and adhered to at all times. Reason: In the interests of amenity in accordance with Policies SWDPR28 and SWDPR35 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The equipment installed to suppress and disperse fumes produced by cooking as agreed under discharge of condition 37 of W/01/01700/PN shall be effectively operated for so long as the use continues. Reason: In the interests of amenity and in accordance with Policies SWDPR35 and SWDPR41 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
There must be no new buildings, structures (including gates, walls and fences) or raised ground levels within 8 metres of the top of the bank of watercourse or within the floodplain asdefined in the Flood Risk Assessment Report for the development. Reason: To maintain access to the watercourse for maintenance or improvements and provide for overland flood flows and in accordance with Policy SWDPR38 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
Floor levels should be set at least 600mm above the 1 in 100 year design flood level as defined in the Flood Risk Assessment of 29.3 metres above Ordnance Datum. Reason: To protect the development from flooding and in accordance with Policy SWDPR38 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The boundary treatment as agreed under the details of the discharge of condition 8 of W/01/01700/PN shall remain and shall not be altered without the consent, in writing, of the Local Planning Authority. Reason: In order to ensure that there is an acceptable form of screening with adjacent properties and in accordance with Policies SWDPR28 and SWDPR35 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The hard and soft landscaping details as discharged on 21 October 2004 shall remain and shall not be altered without the consent, in writing, of the Local Planning Authority. Reason: To protect and enhance the visual amenities of the area and to ensure the satisfactory development of the site and in accordance with Policy SWDPR28 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
In this condition "retained tree" means an existing tree which is to be retained in accordance with the approved plans and particulars and paragraphs 1. and 2. below shall have effect until the expiration of one year from the date of the completion of the development. 1. No retained tree shall be cut down, uprooted or destroyed, nor shall any retained tree be topped or lopped other than in accordance with the approved plans and particulars, without the written approval of the Local Planning Authority. Any topping or lopping approved shall be carried out in accordance with British Standard in force at the time of the work. 2. If any retained tree is removed, uprooted or destroyed or dies, another tree shall be planted at the same place and that tree shall be of such size and species, and shall be planted at such time, as may be specified in writing by the Local Planning Authority. 3. The erection of fencing for the protection of any retained tree shall be undertaken in accordance with the approved plans and particulars before any equipment, machinery or materials are brought on to the site for the purposes of the development, and shall be maintained until all equipment, machinery and surplus materials have been removed from the site. Nothing shall be stored or placed in any area fenced in accordance with this condition and the ground levels within those areas shall not be altered, nor shall any excavation be made, without the written consent of the Local Planning Authority. 4. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree. Reason: The Council considers that these requirements are necessary to protect and enhance the visual amenities of the area and in accordance with Policy SWDPR28 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The raised pedestrian crossings as discharged on 21st October 2004 shall remain and shall not be altered without the consent, in writing, of the Local Planning Authority. Reason: In the interests of highway safety and in accordance with Policy SWDPR6 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The lighting within the car park and any external lighting on the store building shall be as agreed under the details of the discharge of condition 20 of W/01/01700/PN. Any alterations to this lighting will not be permitted unless agreed, in writing, by the Local Planning Authority. Reason: In the interests of amenity and in accordance with Policies SWDPR28 and SWDPR35 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The details of the electrical services to permit open air market stall provision from the urban square to the east of the Talbot Public House as discharged on 21st October 2004 shall be used unless otherwise agreed, in writing, by the Local Planning Authority. Reason: To enable the area to be properly used for market purposes and in accordance with Policies SWDPR6, SWDP28 and SWDPR35 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The floorscape enhancements within the application site (principally floorscape works to Gurneys Lane and the land between Toyworld and The Talbot public house) shall remain as agreed under the details of the discharge of condition 24 of W/01/01700/PN and remain as such thereafter. Any alterations will not be permitted without the consent, in writing, of the Local Planning Authority. Reason: To ensure that the floorscape enhancements remain satisfactory and in accordance with Policy SWDPR28 in the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The detailed design of the archway fronting the High Street as discharged on 21 October 2004 shall remain and shall not be altered without the consent, in writing, of the Local Planning Authority. Reason: To ensure that the development is visually satisfactory and in accordance with Policy SWDPR28 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The toilets to be provided in the entrance lobby of the proposed retail store shall be freely available for public usage during store opening hours. Reason: To ensure the retention of a public toilet facility in this part of the town centre and in accordance with Policies SWDPR28 and SWDPR35 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
The detailed car parking aisle widths of the car parking area on the on the West side of Ricketts Lane as discharged on 21 October 2004 shall remain and shall not be altered without the consent, in writing, of the Local Planning Authority. Reason: To ensure that the car park layout remains satisfactory and in accordance with SWDP6 of the South Worcestershire Development Plan Review and the relevant aims and objectives of the National Planning Policy Framework.
Certain advertisements may be displayed without obtaining the express consent of the Council under the Town & Country Control of Advertisements) Regulations 1992. However, the Council does have the power to take discontinuance action if the signs are detrimental to amenity or safety.
