Condition Details / Information Notes
The attenuation basin is located in an area which is susceptible to high surface flood water risks which has the potential to undermine the effectiveness of the sustainable drainage feature and its ability to manage the surface water run off from the truck stop. No evidence has been provided to demonstrate that the identified flood risk will not impact the attenuation capacity of the drainage system and compromise its effectiveness. The proposed amendment to the approved surface water drainage scheme is therefore considered to conflict with Development Plan Policies SWDPR38 and SWDPR39 in addition to Decision Making Policy F7 and F8 of the NPPF (2026) and is unacceptable.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; * - seeking further information following receipt of the application; * - seeking amendments to the proposed development following receipt of the application; * - considering the imposition of conditions and or the completion of a s.106 legal agreement* In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. * delete as appropriate
