| The external surfaces of the structures that comprise of the facility hereby permitted shall be constructed out of those materials specified in the approved plans and shall be retained in that condition thereafter.
Reason - To ensure that the new materials are in keeping with the surroundings and do not result in a detrimental impact within the landscape in this part in accordance with Policies SWDPR28 and SWDPR34 of the South Worcestershire Development Plan Review.

| Within 35 years and six months following completion of construction of the development hereby permitted, within 12 months of the cessation of operational use, or within six months following a permanent cessation of construction works prior to the battery facility coming into operational use, whichever is the sooner, the batteries, transformer units, inverters, all associated structures and fencing approved shall be dismantled and removed from the site. The developer shall notify the Local Planning Authority in writing no later than twenty-eight working days following cessation of power production. The site shall subsequently be restored in accordance with a scheme and timescale, the details of which shall be first submitted to and approved in writing by the Local Planning Authority no later than six months following the cessation of power production. (Note: for the purposes of this condition, a permanent cessation shall be taken as a period of at least 24 months where no development has been carried out to any substantial extent anywhere on the site).
Reason: In the interests of the visual amenities of the area, so not to risk redundant equipment, structures, buildings and boundary treatments being left in place in perpetuity, compromising the productive use of the land and the character and appearance of the area within this Green Belt location, thereafter.

| The development hereby approved shall be carried out in strict accordance with the details approved by virtue of application W/25/02156/CCO on the 3rd December 2025.
The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved in writing by the local planning authority.
Reason: To ensure the safety of the local highway network in accordance with Policy SWDPR06 of the South Worcestershire Development Plan Review and Paragraph 116 of the NPPF.

| During the first year of operation of the development hereby approved, post completion testing shall be carried out by a professional and competent contractor (Member of the Institute of Acoustics). Two post completion noise testings shall be undertaken, a punctual test during the Winter and a punctual test during the Summer, at close proximity to the BESS development site.
The testing methodology shall be submitted and agreed in writing at least one month prior to the noise testing being carried out.
Reason: To ensure that the operation does not result in adverse impact on nearby residential receptors in accordance with Policies SWDPR28 and SWDPR35 of the South Worcestershire Development Plan Review.

| Prior to first operation of the equipment at the site, the 4.5m acoustic barrier shall be installed in accordance with Section 6 of the Noise Impact Assessment Report, Philip Dunbavin Acoustics Ltd., Plan and Elevation – Acoustic Fence Rev A received dated 12.03.2024 and shown in the approved Site Layout Plan referenced LDS/19652 P1 Rev D ‘Proposed Plan’.
The approved acoustic barrier shall be herby maintained and remain in situ in perpetuity.
Reason: To ensure adequate mitigation from noise nuisance for nearby neighbouring residents in accordance with Policies SWDPR28 and SWDPR35 of the South Worcestershire Development Plan Review, together with Paragraph 187(e) of the NPPF. |
| Prior to the first use of the development, the approved drainage scheme entitled ‘Detailed Drainage Strategy Ref. CRM.366.026.EC.R.001’ discharged by the Local Planning Authority dated 11th October 2023 shall be implemented and thereafter maintained in perpetuity.
Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDPR38 and SWDPR39 of the South Worcestershire Development Plan Review.

| The approved CEMP, CRM.366.026.EC.R.001 Biodiversity Construction Environmental Management Plan, Enzygo dated 16th May 2023 shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the local planning authority.
Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 together with Policy SWDPR29 of the South Worcestershire Development Plan Review.

| Prior to installation, a lighting plan for the operation phase of development, shall be submitted to and approved in writing by the Local Planning Authority. All lighting should be designed in accordance with Bat Conservation Trust / Institution of Lighting Professionals Guidance Note 08/18 Bats and artificial lighting in the UK. Submitted lighting plans should be accompanied by contour diagrams that demonstrates minimal levels of lighting on receptor habitats, including trees and hedges. Development shall be carried out in accordance with the approved details and retained thereafter.
Reason: To ensure adequate protection to biodiversity in accordance with Policy SWDPR29 of the South Worcestershire Development Plan Review.

| The development hereby permitted shall be carried out in accordance with the mitigation and enhancement requirements set out within ‘Ecological Impact Assessment’, produced by Enzygo, September 2022.
Reason: To ensure safeguarding of protected species and biodiversity and to ensure that the development provides for adequate biodiversity enhancement in accordance with Policy SWDPR29 of the South Worcestershire Development Plan Review.

| All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved, shall be carried out in the first planting season following the first occupation/use of the development OR in accordance with the submitted implementation programme. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment.
Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with Policies SWDPR28 and SWDPR34 and to provide adequate biodiversity enhancements in accordance with Policy SWDPR29 of South Worcestershire Development Plan Review.

| The proposed development must be undertaken in adherence to all recommendations and methods of working detailed within the Arboricultural Impact Assessment.
Reason: To ensure that those landscape features and hedgerows are retained and afforded relevant protection in accordance with Policy SWDPR34 of the South Worcestershire Development Plan Review.

| A landscape and ecological management plan (LEMP) shall be submitted to and be approved in writing by the local planning authority within one month of the commencement of the development hereby approved. The content of the LEMP shall include the following:
a. Description and evaluation of the features to be managed;
b. Ecological trends and constraints on site that might influence management.
c. Aims and objectives of management;
d. Appropriate management options for achieving aims and objectives;
e. Prescriptions for management actions;
f. Preparation of a work schedule, including an annual work plan capable of being rolled forward over a five-year period and longer term thereafter;
g. Details of the body or organisation responsible for implementation of the plan;
h. Ongoing monitoring and remedial measures.
A report describing the results of monitoring shall be submitted to the local planning authority at intervals identified in the LEMP strategy. The plan and monitoring report shall also set out where the results of the monitoring show that conservation aims and objectives of the LEMP are not being met, how contingencies and/or remedial action will be identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The approved plan will be implemented in accordance with the approved details.
Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with Policies SWDPR29 and SWDPR30 of the South Worcestershire Development Plan Review.

| The first 15m of the private access roadway, measured from its junction with A38, shall be properly consolidated and surfaced with a bound material. ( Loose material not allowed).
Reason: In the interests of highway safety in accordance with Policies SWDPR06 and SWDPR28 of the South Worcestershire Development Plan Review and Paragraph 116 of the NPPF.

| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
| A Land Drainage Consent is required for all works that have the potential to alter the flow in an ordinary watercourse, as set out in Land Drainage Act 1991 section 23 (as amended). The applicant is advised to contact the SWLDP team at Wychavon DC to discuss the need for a Land Drainage Consent. |
| The applicant should be aware that polluting the nearby brook, for instance by allowing the discharge of sediment rich runoff from the construction site, might constitute an environmental offence. The applicant is expected to fully assess the risks from all pollution sources and pathways and take sufficient precautionary measures to mitigate these risks for this development. |
| If unforeseen contamination is encountered during construction works such as localised spillage an Environmental Consultant will be available on a ‘call out’ basis to undertake an assessment of risk. If ‘unforeseen contamination’ is encountered the discovery strategy will be to remove the source as it is likely to be very limited in extent and the Local Planning Authority advised. Remediation will be undertaken to provide environmental betterment. |
| Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible.
However, birds can nest at any time and the site including any buildings should ideally be checked for their presence immediately before work starts. |
