Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission W/24/00157/FUL which was approved on the 24th September 2025. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 'Location Plan' - Drg No. K991-100, Rev.(A); ‘Proposed Site Plan’ – Drg no. L235-DJD-XX-XX-DR-A-001, revision P04; ‘Plot 1 – Proposed Plans and Elevations’ – Drg no. L235-DJD-XX-ZZ-DR-A-002, rev P02; and ‘Plot 2 – Proposed Plans and Elevations’ – Drg no. L235-DJD-XX-ZZ-DR-A-003, rev P02. Reason: To define the permission in accordance with policies SWDPR01 and SWDPR03 of the South Worcestershire Development Plan Review 2026 and the National Planning Policy Framework.
Prior to the first use / occupation of the development hereby approved, a detailed surface-water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include: a) the drainage of roofs and hardstanding areas; b) the treatment and management of surface-water run-off; c) the management of exceedance flows; and d) where connection to a public sewer is proposed, evidence of the in-principle agreement of Severn Trent Water. The approved scheme shall be fully implemented prior to the first occupation of both dwellings and shall thereafter be managed and maintained in accordance with the approved details. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDPR38, SWDPR39 and SWDPR40 of the South Worcestershire Development Plan Review 2026.
The development hereby approved shall not commence, until a Construction Environment Management Plan has been submitted to and approved in writing by the Local Planning Authority. The approved statement shall be adhered to throughout the construction period. The statement shall provide for: a) The parking of vehicles of site operatives and visitors within the application site. b) Loading and unloading of plant and materials within the application site. c) Storage of plant and materials within the application site. d) Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway. e) Measures to control the emission of dust and dirt during construction f) Responsible persons and lines of communication. g) Details of the routing of HGVs and delivery lorries on the highway network associated with the proposed development to and from the site together with agreed traffic management measures. Reason: In the interests of highway safety, to protect existing and new occupiers of residential areas from the unreasonable effects of construction in respect of noise, vibration, light and dust nuisance, in accordance with SWDPR06, SWDPR28 and SWDPR35 of the South Worcestershire Development Plan Review 2026.
No works beyond site clearance and groundworks with regards the hereby permitted development shall commence until details of the materials to be used in the construction of the external surfaces of the dwellings hereby permitted have been submitted to and approved in writing by the local planning authority. This should include (where applicable): a) details of all brick, render and tiling (including details of the colour of render/paintwork to be used); b) details of all cladding to be used, including details of their treatment to protect against weathering; c) details of all hard surfacing materials; and d) details of the proposed window and door treatments (Including colour and material). Development shall be carried out in accordance with the approved details and thereafter be maintained in accordance with the approved details. Reason: To ensure that the new materials are in keeping with the surroundings and represent quality design and an acceptable appearance and finish to the proposals, in accordance with Policies SWDPR05, SWDPR09, SWDPR28 and SWDPR33 of the South Worcestershire Development Plan Review 2026, and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the area within the curtilage of each dwelling for the parking of cars as shown on the approved plans listed under Condition 2 of this Decision Notice (at a gradient not exceeding 1 in 8) has been provided. This area shall thereafter be retained for the purpose of parking vehicles only. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with policies SWDPR06 and SWDPR28 of the South Worcestershire Development Plan Review 2026.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement submitted and approved as part of application W/24/00157/FUL shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDPR 39 of the South Worcestershire Development Plan Review 2026.
No works in relation to any boundary treatments required by this condition shall take place until there has been submitted to and approved in writing by the Local Planning Authority a plan indicating the position, type, design and materials or planting specification of any boundary treatment to be erected or planted. The boundary treatment shall be completed before the dwellings are occupied (in accordance with a timetable to be agreed in writing with the local planning authority). Development shall be carried out in accordance with the approved details. Any hedges shall be maintained for a period of 5 years. During this time, any shrubs that are removed, die or are seriously retarded shall be replaced during the next planting season with others of similar sizes and species unless the Local Planning Authority gives written consent to any variation. If any plants fail more than once they shall continue to be replaced on an annual basis until the end of the 5-year maintenance period. Reason: To ensure the proposed development represents high quality design and does not have an adverse effect on the character and appearance of the area in accordance with policies SWDPR05, SWDPR28 and SWDPR34 of South Worcestershire Development Plan Review 2026.
The development shall be carried out in accordance with the recommendations contained within the Updated Preliminary Ecological Appraisal prepared by Worcestershire Wildlife Consultancy and dated 19 May 2025. In particular: a) any open trenches shall be covered when not in use or provided with a 45-degree escape ramp; b) before the removal of the ash tree, it shall be inspected by a suitably qualified arboricultural specialist and bat Ecological Clerk of Works for evidence of roosting bats; c) tree, shrub and vegetation clearance shall be undertaken outside the bird-nesting season of 1 March to 31 August inclusive, unless a suitably qualified ecologist has confirmed immediately before the works that no active nests would be affected; and d) existing piles of brash and stone shall be cleared by hand. If development has not commenced by 19 May 2027, no development shall commence until an updated Preliminary Ecological Appraisal has been submitted to and approved in writing by the Local Planning Authority. Any additional surveys, mitigation or precautionary measures identified by the updated appraisal shall thereafter be implemented in accordance with the approved details. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDPR29 of the South Worcestershire Development Plan Review 2026.
Prior to the occupation of any part of the development hereby permitted details of renewable or low carbon energy generating facilities to be incorporated as part of the development shall be submitted to and approved in writing by the local planning authority. The details shall demonstrate that at least 20% of the predicted energy requirements of the development will be met through the use of renewable/low carbon energy generating facilities. The approved facilities shall be provided prior to any part of the development hereby permitted being first occupied or in accordance with a timetable submitted to and approved by the local planning authority as part of the details required by this condition. Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with Policy SWDPR37 of the South Worcestershire Development Plan Review 2026.
Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDPR05, SWDPR28 and SWDPR34 of South Worcestershire Development Plan Review 2026.
Prior to the first use / occupation of the dwellings hereby approved, 2no. nesting features for house sparrows and house martins shall be positioned beneath the eaves of the dwelling(s) at a minimum height of 2 metres on a suitable elevation. The approved nesting features shall be installed and retained in perpetuity. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDPR29 of the South Worcestershire Development Plan Review 2026.
The dwelling(s) hereby approved shall be constructed to meet the requirements of Building Regulations Approved Document M4(2) (Accessible and Adaptable Dwellings), or any subsequent equivalent standard. Where it is considered that compliance with the M4(2) standard is not feasible due to site-specific constraints, including listed building constraints, flood risk or site topography, details and evidence demonstrating why compliance is not feasible shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of construction of the relevant dwelling(s) Reason: To ensure the provision of accessible and adaptable dwellings in accordance with Policy SWDPR 17 of the South Worcestershire Development Plan Review 2026 and paragraph 135(f) of the National Planning Policy Framework.
The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein.
