Condition Details / Information Notes
Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. Work should take place outside the main nesting season, which lasts approximately from March to late August, if at all possible. However, birds can nest at any time and the site should therefore be checked for their presence immediately before work starts.
Great Crested Newts have been recorded nearby and it is possible that they could be present within the hedge. Great Crested Newts are fully protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2017, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately capture, kill or injure a great crested newt, to damage or destroy a breeding site or resting place or to intentionally or recklessly disturb any wild great crested newt while it is occupying a structure or place that it uses for shelter and protection. Works can only be carried out following appropriate advice from a suitably qualified ecologist. Should any Great Crested Newts be found, works must cease immediately and an ecological consultant must be contacted for advice on the best way to proceed in consultation with Natural England and the local planning authority. All contractors working on site should be made aware of the advice and provided with the contact details of the relevant ecological consultant.
