Condition Details / Information Notes
The application site lies outside any development boundary as identified under adopted South Worcestershire Development Plan Review Policy SWDPR 03. The site is therefore defined as being ‘open countryside’ where development is strictly controlled subject to other policies in the Plan. The principle for housing development comprising of an open market dwelling on this site is not established by any of the other housing policies listed within the South Worcestershire Development Plan Review (March 2026). Accordingly, the location and scale of development fails to accord with the provisions of Policy SWDPR 03 part D of the South Worcestershire Development Plan Review 2026 and conflicts with the development strategy underpinning the adopted Local Plan, which seeks to focus most development on the urban areas where both housing needs and accessibility to lower-cost public services are greatest. In addition, Fladbury is identified as a Category 4 village within the Settlement Hierarchy and whilst the site would benefit from pedestrian access to the limited range of services and facilities within the village, it is not served by public transport and future occupiers would be reliant to a significant extent on private vehicles to access wider services, facilities and employment opportunities contrary to Policies SWDPR 01 and SWDPR 06. Therefore, the proposal would fail to represent development of an appropriate scale and type having regard to its location, Settlement Hierarchy classification and infrastructure capacity, contrary to Policy SWDPR 03 Parts D and E of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework. It is concluded that the location of the site is not suitable for residential development and that the proposal, considered holistically, fails to represent sustainable development.

In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however been unable to seek solutions to problems arising from this application as the applicant has failed to provide a scheme that would comply with the statutory policies of the development plan and would not overcome the reasons for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
