Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Proposed Site Plan 7710-P-010 Proposed Floor Plans Plots 1-4 7710-P-300 Proposed Elevations 1-4 7710-P-700 Existing & Proposed Street Scene 771-P-701 Existing Site Location Plan 22427-SSJ-XX-XX-DR-A-(01)001 Demolition Plan 22427-SSJ-XX-XX-DR-A-(01)002 Reason: To define the permission in accordance with policies SWDPR01 and SWDPR03 of the South Worcestershire Development Plan Review 2026 and the National Planning Policy Framework.
The development hereby permitted shall be in strict accordance with the approved external materials and details contained within the document titled ‘Discharge of Planning Condition 3: External Materials to be used’ pdf. Reason: To ensure a satisfactory external appearance of the development and that high quality materials and finishes are used, in accordance with policies SWDPR28 and SWDPR34 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be in strict accordance with the approved Geo-environmental desk study and contamination risk assessment report for 33-37 Hemmingway, Evesham, WR11 1HH (Report No.5618), undertaken by Wilson Associates. In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where necessary a remediation scheme must be prepared, these will be subject to the approval of the Local Planning Authority. Following the completion of any measures identified in the approved remediation scheme a validation report must be prepared, which is subject to the approval in writing of the Local Planning Authority prior to the occupation of any buildings. Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors and in accordance with Policies SWDPR28, SWDPR35 and SWDPR42 of the South Worcestershire Development Plan Review,2026 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be in strict accordance with the approved documents '‘Discharge of Planning Condition 5: Foul and Surface water drainage’ pdf.', the Geotechnical assessment report 33-37 Hemmingway, Evesham WR11 1HH’ Report No.5618/2 (dated: 21st January 2026), undertaken by Wilson Associates, the ‘Proposed Drainage Site Plan’ (101-04), the Severn Trent letter ‘One Surface Water Sewage Connection’ Reference number: 117 3805 (7181212) SW, dated 26th March 2026 and the Severn Trent letter ‘One Foul Water Sewage Connection’ Reference number: 1173803 (7181211)FW, dated 26th March 2026. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDPR38, SWDPR39 and SWDPR40 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be in strict accordance with the approved documents 'Geotechnical assessment report 33-37 Hemmingway, Evesham WR11 1HH’ Report No.5618/2 (dated: 21st January 2026), undertaken by Wilson Associates and the ‘Discharge of Planning Condition 6: Percolation test’ pdf. Reason: To ensure that the site can be adequately drained and in accordance with Policies SWDPR38 and SWDPR39 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be in strict accordance with the approved documents '‘Discharge of Planning Condition 7: Renewable and Low Carbon energy generation’ pdf, Predicted Energy Assessment (date of assessment: 30/03/2026) and the Energy Statement, undertaken by Complete Energy Consultancy (dated 30/03/2026). Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDPR37 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be in strict accordance with the approved documents Landscape Ecological Management Plan (LEMP), dated 18th May 2026, undertaken by Arbtech and the Biodiversity Gain Plan, received by the Local Planning Authority 1/06/2026. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDPR29 and SWDPR30 of the South Worcestershire Development Plan,2026 and the relevant aims and objectives of the National Planning Policy Framework.
The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved Landscape and Ecological Management Plan (LEMP). Reason: To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990 and Policies SWDPR29 and SWDPR30 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the first 5m of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety and in accordance with Policy SWDPR6 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby permitted shall not be occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards and in accordance with Policy SWDPR6 of the South Worcestershire Development Plan,2026 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the access, parking and turning facilities have been provided as shown on Drawing Number 7710-P-010. REASON: To ensure conformity with summited details and in accordance with SWDP4 of the South Worcestershire Development Plan, 2016, emerging South Worcestershire Development Plan Review (namely Policy SWDPR6) and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be in strict accordance with ‘Discharge of Planning Condition 13: Construction Management Plan), received by the Local Planning Authority 8/05/2026) pdf. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety and in accordance with Policy SWDPR6 of the South Worcestershire Development Plan Review,2026 and the relevant aims and objectives of the National Planning Policy Framework.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays. Reason - To preserve the amenities of the locality in accord with Policies SWDPR28 and SWDPR35 of the South Worcestershire Development Plan,2026 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be in strict accordance with ‘Discharge of Planning Condition 15: Scheme of Landscaping’ pdf and Drawing 445 103-01. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with Policies SWDPR28 and SWDPR34 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall be in strict accordance with ‘Discharge of Planning Condition 16: Hard landscaping' and Drawing 445 103-01. Reason - To ensure the proposed development represents high quality design and does not have an adverse effect on the character and appearance of the area in accordance with policies SWDPR28 and SWDPR34 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall proceed in strict accordance with the recommendations outlined in the Preliminary Ecological Appraisal and Roost Assessment, dated 24th July 2025 undertaken by Arbtech. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with Policy SWDPR29 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
Before the first occupation of the building(s) hereby permitted the windows at ground level for the utility rooms in plots 1,2,3 & 4 shall be fitted with Pilkington Level 4 obscured glazing or equivalent and shall be permanently retained in that condition thereafter. Reason - To protect the amenities of nearby properties from unacceptable overlooking/loss of privacy and represent quality design in accordance with Policies SWDPR 28 and SWDPR 35 of the South Worcestershire Development Plan,2026 and the relevant aims and objectives of the National Planning Policy Framework.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no (restricted works)(additions, extensions or external alterations) (new windows or other openings) (building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwelling house) shall be constructed/carried out on the application site following the completion/first use of the development hereby permitted. Reason: To safeguard the character and appearance of the development and its surroundings, and to ensure a high standard of design in accordance with Policies SWDPR 28 and SWDPR35 of the South Worcestershire Development Plan Review, 2026 and the relevant aims and objectives of the National Planning Policy Framework.
Before undertaking any work on site, all applicants must determine if Severn Trent has any assets in the vicinity of the proposed works. This can be done by accessing our records at www.digdat.co.uk Severn Trent Water advise that even if our statutory records do not show any public sewers within the area you have specified, there may be sewers that have been recently adopted under The Transfer of Sewer Regulations 2011. Our records indicate that there are assets that may be a??ected by this proposal and as such the applicant must contact Severn Trent before any work takes place. Public sewers and Water mains have statutory protection and may not be built close to, or diverted without consent, consequently you must contact Severn Trent Water to discuss your proposals. Severn Trent will seek to assist you obtaining a solution which protects both the public sewer and the proposed building.
Please note for the use or reuse of sewer connections either direct or indirect to the public sewerage system the applicant will be required to make a formal application to the Company under Section 106 of the Water Industry Act 1991. They may obtain copies of our current guidance notes and application form from either our website (www.stwater.co.uk) or by contacting our Developer Services Team (Tel: 0800 707 6600).
Alteration of Highway to Provide New or Amended Vehicle Crossover This permission does not authorise the Applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The Applicant is solely responsible for all costs associated with construction of the access. No Drainage to Discharge to Highway Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway. Protection of Visibility Splays The Applicant's attention is drawn to the need to ensure that the provision of the visibility splay(s) required by this consent is safeguarded in any sale of the application site or part(s) thereof. Section 171 Licence A S171 Licence must be obtained from Highways Network Management prior to undertaking any works or excavation of the adopted highway. Construction Traffic Management Plan (CTMP) It is expected that contractors are registered with the Considerate Constructors scheme and comply with the code of conduct in full, but particular reference is made to "respecting the community" this says: Constructors should give utmost consideration to their impact on neighbours and the public •Informing, respecting and showing courtesy to those affected by the work; •Minimising the impact of deliveries, parking and work on the public highway; •Contributing to and supporting the local community and economy; and •Working to create a positive and enduring impression and promoting the Code. The CTMP should clearly identify how the principal contractor will engage with the local community; this should be tailored to local circumstances. Contractors should also confirm how they will manage any local concerns and complaints and provide an agreed Service Level Agreement for responding to said issues. Contractors should ensure that courtesy boards are provided, and information shared with the local community relating to the timing of operations and contact details for a site coordinator in the event of any difficulties. This does not offer any relief to obligations under existing Legislation.
The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. Subject to Paragraph 14(2) of Schedule 7A TCPA 1990 The biodiversity gain plan must include: (a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; (b) the pre-development biodiversity value of the onsite habitat; (c) the post-development biodiversity value of the onsite habitat; (d) any registered offsite biodiversity gain allocated to the development and the biodiversity and the biodiversity value of that gain in relation to the development; (e) any biodiversity credits purchased for the development; and (f) any such other matters as the Secretary of State may by regulations specify. Advice about how to prepare a Biodiversity Gain Plan and a template can be found at https://www.gov.uk/guidance/submit-a-biodiversity-gain-plan Reason – To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan, 2016, the emerging South Worcestershire Development Plan Review (namely Policies SWDPR 29 & 30) and the relevant aims and objectives of the National Planning Policy Framework.
