I write further to your notification application of the proposal for demolition. Based upon the information provided with your application (listed below), I hereby confirm the Council's determination that prior approval is not required as to the method of demolition and any proposed restoration of the site:- Evesham Site Demolition Plan - Dwg No. BK-2607-9
The applicant should be aware that demolition must be carried out within 5 years of the date of this decision.
It is advised that an asbestos survey is undertaken prior to demolition of the buildings. Any mitigation measures identified as being necessary following the survey should be implemented prior to demolition. Appropriate asbestos surveys prior to demolition/alterations and handling of asbestos containing materials (ACM) during works should be undertaken by competent and qualified professionals with experience of surveying and handling of such materials. Any ACMs should be disposed of appropriately such that the development site may not be considered contaminated land under Part 2A at a later date.
The demolition shall take place in accordance with the following plans and documents - Evesham Site Demolition Plan - Dwg No. BK-2607-9
The applicant and any appointed contractors are reminded of their legal responsibilities under the Water Resources Act 1991 and the Environmental Permitting (England and Wales) Regulations 2016. In particular, care must be taken during any demolition, remediation, or construction works to prevent the pollution or contamination of controlled waters, including groundwater and nearby watercourses. Appropriate mitigation measures should be implemented throughout the course of the works to safeguard water quality.
The applicant is advised that the proposed site restoration works are likely to require planning permission. This is because the works would constitute “development” as defined under Section 55(1) of the Town and Country Planning Act 1990 (as amended), insofar as they involve building operations and engineering activities, and because permitted development rights do not exist for the proposed works. The applicant should seek planning permission from the Local Planning Authority prior to the commencement of any such works.
