Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission W/23/02281/FUL dated 20 May 2024. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents: - Location Plan, Drawing no: 23-007/001, Dated July 2023; - Planning and Landscaping Layout, Drawing no: 23-007/002 Rev D - House Type A, Drawing no: 23-007/03 rev A. - House Type B, Drawing no: 23-007/04 rev B. - Garage and Workspace Details, Drawing no: 23-007/05 rev A. - Boundary Treatments, Drawing no: 23/007/06 rev A. - Street Scene, Drawing no: 23-007/07 rev A. - External Works Plan, Drawing no: 23-007/514 Dated July 2023; - Private Drainage, Drawing no: 23-007/515 Dated July 2023; - Desk Study Report by ASL; - Energy and Sustainability Statement by Shire Group BSC Ltd including Appendix A; - Residential Noise Assessment by Nova Acoustics; - Water Management Strategy by CADSquare Midlands Ltd; - Preliminary Ecological Appraisal by Countryside Consultants Ltd dated 09/05/24. Reason: To define the permission in accordance with policies SWDPR01 and SWDPR03 of the South Worcestershire Development Plan Review 2026 and the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDPR 39 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
No development shall take place (including any ground works or vegetation clearance) until a Construction Environmental Management Plan (CEMP: Biodiversity) has been submitted to and approved in writing by the Local Planning Authority. The CEMP (Biodiversity) shall be based on the recommendations made in the Preliminary Ecological Appraisal report by Countryside Consultants Ltd, dated 9th May 2024, and shall include the following: a. Risk assessment of potentially damaging construction activities; b. Identification of “biodiversity protection zones”; c. Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts during construction (may be provided as a set of method statements); d. a detailed reptile translocation strategy to include pre-commencement habitat creations in receptor area; e. The location and timing of sensitive works to avoid harm to biodiversity features; f. The times during construction when specialist ecologists need to be present; g. Responsible persons and lines of communication; h. The role and responsibilities on site of an ecological clerk of works (ECoW) or similarly competent person; i. Use of protective fences, exclusion barriers and warning signs. The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the local planning authority. Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and policy SWDPR 29 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
Notwithstanding the approved plans, prior to the commencement of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting, numbers/densities of plants and timescales for the landscaping scheme to be implemented and completed. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. The landscaping scheme shall be based on the recommendations made in the Preliminary Ecological Appraisal Report by Countryside Consultants Ltd dated 9th May 2024 and shall include both the development site and off-site enhancements. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area or on existing biodiversity interests at the site, in accordance with policies SWDPR 28, SWDPR 29 and SWDPR 34 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
Before the development hereby permitted is first occupied/used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDPR 29 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
Before the first occupation of any part of the development hereby permitted, details of wildlife boxes shall be submitted to and approved in writing by the Local Planning Authority. The boxes shall be based on the recommendations made in the Preliminary Ecological Appraisal by Countryside Consultants Ltd date 9th May 2024. The details to be submitted shall include an implementation timetable. The feature(s) shall be provided in accordance with the approved details and in accordance with the approved timetable. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDPR 29 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
Notwithstanding the approved details, prior to their installation details of all boundary treatments shall be submitted to and approved in writing by the Local Planning Authority. The proposed boundary treatments shall include a 130mm gap at the base of any close boarded fencing to allow for hedgehog access. The boundary treatments shall be implemented as approved. Reason: In the interests of visual amenity and the protection/enhancement of biodiversity interests at the site, in accordance with policies SWDPR 28, SWDPR 29 and SWDPR 34 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
No development shall take place (including any ground works or vegetation clearance) until a Landscape and Ecological Management Plan (LEMP) has been submitted to and approved by the Local Planning Authority for both the development site and off-site habitat areas. The approved LEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with with policy SWDPR 29 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
The noise mitigation recommendations included within the Residential Noise Assessment by Nova Acoustics shall be implemented and retained thereafter. Reason: In the interests of protecting residential amenity against noise from the nearby railway line, in accordance with policy SWDPR 35 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation. No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed by the Local Planning Authority, until requirements 1 to 4 below have been complied with: 1. Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency’s ‘Land Contamination: Risk Management’ guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place. 2. Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation. 3. The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. 4. Following completion of measures identified in the approved remediation scheme a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site. Reason: To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with policy SWDPR 42 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not be occupied until the access, parking and turning facilities have been provided as shown on drawing 23-007 / 002 Rev D. REASON: To ensure conformity with summited details and in the interests of highway safety in accordance with policy SWDPR 06 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
Development shall not begin until visibility splays are provided from a point 0.6m above carriageway level at the centre of the accesses to the application site and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 82 metres in each direction measured along the nearside edge of the adjoining carriageway and offset a distance of 0.6m from the edge of the carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above. Reason: In the interests of highway safety and in accordance with policy SWDPR 06 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the first 5 metres of the accesses into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety and in accordance with policy SWDPR 06 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not be occupied until an area has been laid out within the curtilage of each dwelling for the parking of 3 cars at a gradient not exceeding 1 in 8. This area shall thereafter be retained for the purpose of parking a vehicle only. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway and in accordance with policy SWDPR 06 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
No dwelling hereby permitted shall be occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards and in accordance with policy SWDPR 01 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
Notwithstanding the approved details, the development hereby permitted shall not commence until drainage plans for the disposal of foul and surface water flows have been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details before the development is first brought into use. It should be noted that Severn Trent Water would not permit a surface water discharge into the public foul sewer and the applicant is recommended to seek alternative arrangements. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDPR 38 SWDPR 39 and SWDPR 40 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in accordance with the approved details. contained within the Energy and Sustainability Statement by Shire Group BSC Ltd including Appendix A Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDPR 37 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the first occupation of any of the dwellings hereby approved, superfast broadband facilities or alternative solutions shall be installed within each dwelling. Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in accordance with policy SWDPR 36 of the South Worcestershire Development Plan Review (March 2026) and the relevant aims and objectives of the National Planning Policy Framework.
In order to minimise any nuisance from noise, vibration and dust emissions during the construction phase, the applicant should refer to the Worcester Regulatory Services Code of Best Practice for Demolition and Construction Sites and ensure its recommendations are complied with.
This permission does not authorise the Applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The Applicant is solely responsible for all costs associated with construction of the access.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
