South Worcestershire Development Plan Review policies SWDPR 02 and SWDPR 03 set out that the development strategy for the adopted plan is to provide for and facilitate the delivery of sufficient housing to meet objectively assessed needs to 2041. The council can demonstrate a deliverable 5 years supply of housing land to meet this identified need. The application site lies within the open countryside as defined by SWDPR 03, where new development is strictly controlled and limited to specific uses none of which apply in this case. The primacy of an up-to-date development plan is enshrined in paragraph 12 of the National Planning Policy Framework. In this case, the proposed development, due to its location outside of the settlement boundaries defined within the South Worcestershire Development Plan Review, conflicts with Policy SWDPR 03 of the South Worcestershire Development Plan Review (2026) and the National Planning Policy Framework.
As a result of its proposed location, land use and amount, the development would represent an incongruous addition to the local landscape. More specifically, the application site is located beyond the southern extent of the group of dwellings located to the north. As such, it is considered that the redevelopment of the site for up to four dwellings would represent the further encroachment of residential development into the open-countryside. Furthermore, with the exception of the group of dwellings located to the north and the linear grouping of dwellings located to the west and south-west of the application site, the built development within Norton is predominantly located on the western side of the B4088 Evesham Road. As such, and in light of the above, it is considered that redevelopment of the site for a minimum of 3 and a maximum of 4 dwellings and the subsequent further encroachment of residential development into the open countryside on the eastern side of the B4088 Evesham Road, would fail to respect the predominant settlement pattern within the immediate surrounding area.
In light of this, the proposed development is contrary to policies SWDPR 05, SWDPR 28 and SWDPR 34 of the South Worcestershire Development Plan Review (2026) and Chapter 12 of the National Planning Policy Framework.
Positive and Proactive Statement. In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan and Supplementary Planning Documents and provided the applicant with the opportunity to engage with the Council's pre application advice service. Despite these efforts, the Council still consider that permission in principle should be refused for the reasons set out within the decision notice.
