Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where otherwise required/allowed by other conditions attached to this permission, the development hereby permitted shall be carried out in accordance with the following approved plans: Block plan 1:500 Site location plan 1:1250 Reason - To define the permission.
The site shall not be occupied by any persons other than gypsies and travellers as defined in Annex 1: Glossary of Planning Policy for Traveller Sites (or its equivalent in replacement national policy). Reason: Significant weight has been attached to the assessment of this application in terms of the contribution that this site would make towards achieving a 5 years supply of gypsy/traveller pitches.
No more than 2 caravans, as defined in the Caravan Sites and Control of Development Act 1960 and the Caravan Sites Act 1968 as amended (of which no more than 1 shall be a static caravan) shall be stationed on the site at any time. Reason - To ensure the proposed development causes no significant visual harm.
No vehicle over 3.5t shall be stationed, parked or stored on the site. Reason: To limit the visual impact of the approved development
No commercial activities shall take place on the land, including the storage of materials. Reason - The site is in open countryside and not considered to be suitable for commercial activities.
No external lighting shall be installed on the site. Reason - The site is in open countryside where external lighting could be intrusive on the visual amenities of the area.
The Development hereby approved shall not be occupied until the proposed access gates have been set back 5 metres from the adjoining carriageway edge, and made to open inwards only. REASON: In the interests of highway safety.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
The development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. REASON: In the interests of highway safety.
Development shall not be occupied until visibility splays are provided from a point 0.6m above carriageway level at the centre of the access to the application site and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 240 metres to the north and 180 metres to the south along the nearside edge of the adjoining carriageway and offset a distance of 0.6m from the edge of the carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above. REASON: In the interests of highway safety.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access.
The Development hereby approved shall not be occupied until the access, turning area and parking facilities shown on the approved plan has been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times. REASON: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
